The Issue
I, as a parent, have experienced firsthand the fundamental flaws in our current family law that led to the painful separation of my children. At a time when our family was undergoing a lengthy custody battle, my eldest child became a legal adult. This progression in age, however, meant that she was denied the right to maintain essential sibling relationships, a right that is critically important for familial bonds and character development.
Legally, under chapter 39.4024 of the Florida Statute, there is no provision or framework to ensure visitation rights for adult siblings. This restrictive statutory language prevents adult siblings from meaningful interaction, thus eroding the bedrock of family relationships. Despite the court and both parents being in agreement to grant visitation rights to my eldest daughter, the absence of legal prescripts supporting this meant that the visitation coordinator would not permit it.
Presently, there are more than 20 million siblings in the U.S who have been separated due to varied circumstances like divorce, custody battles, or child protection actions. This is a reflection of a major systemic issue that needs immediate redress.
It is for this reason that we need to demand an amendment to Chapter 39.4024 of the Florida Statute to include clauses that support adult sibling visitation rights, thus paving the way for more comprehensive family laws that cater to all involved. This initiative will not only aid in maintaining the social fabric within families but also promote comprehensive mental and emotional well-being of the siblings involved.
