Amend Alberta's Family Law Act to Enhance Recognition of Family Pets

The Issue

The current pet custody provisions under Alberta's Family Law Act do not adequately address the emotional bond between pets and their owners. Pets are often seen as property rather than sentient beings with feelings and emotions. This can lead to distressing situations during separations or divorces, where one party may lose access to a beloved pet without consideration of their emotional attachment or the pet's wellbeing.

In January 2024, British Columbia amended its Family Law Act, changing how pets are considered in the context of divorce and separation proceedings. As a result of the changes to the legislation, a family pet's best interests will now be considered in determining which party is granted possession of them, and  Courts may now require parties to uphold agreements regarding the shared ownership or exclusive ownership of the animal.

These laws recognize that animals are sentient beings whose best interests should be considered in legal proceedings. We believe it is time for Alberta to follow suit and amend its Family Law Act to reflect this reality. We urge lawmakers in Edmonton, AB, Canada to take action on this important issue.
