Right now, strict rules under Proposition 103 make it difficult for insurers to fully use telematics (real-time driving data from your car) when setting auto insurance rates. As a result, programs that reward safer driving are limited in our state.
For example:
- Tesla Insurance in California cannot use its Safety Score to determine premiums (it’s only available for educational purposes), even though the same system helps drivers in other states get lower rates.
- Companies like Lemonade already offer significant discounts for miles driven with Tesla Full Self-Driving (FSD) Supervised in states where regulations allow it — because data shows these miles are substantially safer.
We, the undersigned California residents and drivers, call on the next California Insurance Commissioner to:
- Modernize the approval process for usage-based insurance (telematics) programs so that real driving data can be used to set fairer, more personalized rates.
- Support discounts for drivers who use proven safety technologies, including FSD Supervised and other advanced driver assistance systems, when the data clearly demonstrates reduced risk.
- Ensure any new telematics programs include strong consumer privacy protections, giving drivers full transparency and control over their data.
- Work with innovative insurers (including Tesla and Lemonade) to bring affordable, data-driven auto insurance options to California without compromising consumer safeguards.
Lower rates for safer drivers will make insurance more affordable for millions of Californians, encourage safer roads, and allow new technologies to benefit the people who use them responsibly.
This is not about letting insurance companies do whatever they want — it’s about using 21st-century data and technology to create a fairer system.
