The Issue

As a home-based vendor and a special needs parent, running a small business presents unique challenges. I participate actively in my town’s Farmer's Market and, to accommodate customers who cannot attend, I set up a small porch pick-up stand. However, my hopeful solution was halted when the city informed me that my stand had to be taken down due to zoning restrictions within city limits.

Being a special needs parent, holding multiple jobs is simply not feasible. I am an Autism mother, my child’s needs are a constant priority. Yet, I strive to show my daughter the importance of perseverance and not giving up on dreams, no matter how formidable the obstacles might seem. The ability to operate a roadside stand within city limits would not only provide my business with needed flexibility but also serve as a testament to resilience and determination.

Currently, zoning laws in many cities, including our own, place restrictions on roadside stands within city limits, limiting the opportunities for home-based vendors like myself to thrive. These roadside stands are vital for small businesses, especially those run by single parents or caregivers, as they offer additional avenues for customer interaction, increased visibility, and direct community engagement.

According to the U.S. Small Business Administration, small businesses are the lifeblood of the American economy, creating two out of every three new jobs and driving innovation. In our community, small vendors contribute significantly to the local economy by offering unique products and fostering a vibrant market culture. Allowing roadside stands within city limits would not only empower local entrepreneurs but also enhance community ties and local commerce.

We need a pragmatic approach to bridge the gap between city regulations and the needs of home-based vendors. The city could establish specific guidelines that accommodate roadside stands, such as ensuring they do not obstruct pedestrian traffic and maintaining a clean and safe environment. Other cities have successfully implemented similar measures, reflecting a growing recognition of the importance of supporting small business ventures.

Let's encourage our city officials to reconsider current zoning restrictions and carve a pathway for roadside stands to operate legally within city limits. By doing so, we recognize the vital role played by small vendors in our community and provide them with an opportunity to flourish. Home-based vendors are treated the same as other vendors under the city's Unified Development Ordinance (UDO) — there is no separate restriction that singles out home-based stands. Setting up a stand on residential property is generally something that would be reviewed through our Board of Zoning Appeals process, which is a citizen board rather than city staff. That process requires a public hearing, and neighboring property owners must be notified and have the right to speak if they have concerns. If a stand was taken down, it's likely a neighbor raised an objection, which triggered that review. Anyone looking to set up a stand like this is welcome to reach out to our Planning and Building Services Department, who can walk them through the Board of Zoning Appeals process step by step. One important note: not every address with a Crawfordsville mailing address is actually within our city limits. Some fall outside the incorporated area and are governed by Montgomery County rather than the City of Crawfordsville. If that's the case here, the vendor would need to follow the county's process instead, which is similar in structure.
