Under Ohio's existing law, once parental rights are terminated, the possibility of reinstating those rights does not exist. However, people do change. Circumstances can improve, and often, parents find themselves in a much better position to care for their children after some time and serious effort. Other states have recognized this potential for change and established pathways for reinstating parental rights, provided specific conditions are met, such as demonstrating a substantial improvement in circumstances.
Currently 22 , States like California, Washington, and Illinois have successfully implemented laws that allow for the reinstatement of parental rights where it is in the best interest of the child. These cases consider the parent's current situation and ability to provide a stable and loving environment. Adopting a similar approach in Ohio would not only mend families but also benefit children who can return to a loving and supportive environment.
