Allow Micro Needling & Lancets for CA Licensed Estheticians
The Issue
The Issue: California Licensed Estheticians are currently NOT ALLOWED to use Micro needling devices & lancets.
The Facts:
- Under FDA guidelines, licensed estheticians can only use micro needling devices of less than 0.3 mm and only those that do not make medical claims.
- Many other states (31) allow Licensed Estheticians to perform micro needling, but NOT California.
- For Example: In Kansas, a recent ruling states: These procedures (micro needling, lancets) are for esthetic purposes only and are permitted within the scope of practice as they are noninvasive and confined to the nonliving cells of the epidermis found in the stratum corneum layer of the skin. GOOD NEWS

Why It Matters:
- California Licensed Estheticians are losing clients and income.
- Consumers are paying much higher prices for these same devices to be used by a medical spa or physician's office.
- California Licensed Estheticians are the best trained and should be allowed to use these incredibly efficient, safe and useful devices for their clients.
- Many California Licensed Estheticians are moving to more friendlier states that allow micro needling and lancet use such as: Nevada, Arizona, New York, Florida, Kansas, North Carolina, Nebraska etc.
- California is losing professional residents, tax dollars and small business entrepreneurs because CA has not progressed in esthetics as other states.
- The consumer will receive a more results oriented, much safer and better treatment if a Licensed Esthetician uses these minimal devices in their facial service.
- Without basic, light micro needling, products do not penetrate the epidermis properly and sometimes cause comedomes (pore blockage). Even very expensive products have molecules that are too big and need help penetrating the epidermis to be effective. This allows for consumer value when receiving these services.
- Basic. light micro needling helps repair acne scars and uneven skin tone, which is a major concern of all esthetic consumers. This allows for consumer value when receiving these services.
- Without using a small lancet, tougher extractions pierce through the epidermis, ripping the skin leaving scars and facial marks. The lancet makes a sterilized perforation in the top layer of skin, allowing for an easy, smooth safe extraction. This allows for real consumer safety vs manual, aggressive extractions.
- Micro needling devices and lancets can be purchased in cosmetic retail and drug stores. They do not require a prescription for sale or use and are easily found on the internet for purchase. Consumers buy these devices all the time and use at home.
- California Licensed Estheticians and of course, non licensed individuals are using these devices safely daily in their personal and consumer based services regardless of the prohibition in the current California Board of Barbering & Cosmetology Esthetician scope of practice.
- California Licensed Estheticians do not want to perform their services outside the scope of their practice and do not want to use these helpful and safe devices illegally. California Licensed Estheticians want legal permission to do the best job they can do for the consumer and for their vocation.
Therefore, this petition requests that:
The California Board of Barbering and Cosmetology amend the California Esthetician Scope of Practice to include:
- 1-Micro needling devices less than .3 millimeters and that no medical claims are allowed to be made during this procedure in accordance with the FDA ruling.
- 2-Over the counter, 30 gauge, retail, plastic base lancets are allowed for performing safer and non irritating extractions and that no medical claims are allowed to be made during this procedure.
Summary:
- Please assist the California Licensed Esthetician in adding micro needling and lancet use to their scope of practice.
- In order to stay competitive, make a viable income and provide excellent skin services to their clients we need this legislation from the CA Board of Barbering and Cosmetology Esthetician Scope of Practice to be amended!
- California Licensed Estheticians recognize and respect the fact that they ARE NOT medical professionals, cannot diagnose illness or perform or assist in treatments that Licensed Medical Doctors can do.
Let's work together to take these services from "underground use" to the legal forefront! None of us want to work outside our legal scope, so let's work to change the rules the correct, right and fair way!
