I am writing as a resident of Kentucky to respectfully request that the Kentucky Transportation Cabinet review and amend its current policy regarding REAL ID eligibility for non-U.S. citizens.
Specifically, I urge the Cabinet to align the Commonwealth's requirements with the federal guidelines established under the REAL ID Act.

According to the U.S. Department of Homeland Security (DHS), states are permitted to issue REAL ID-compliant driver's licenses and identification cards to individuals who demonstrate lawful presence in the United States-including those with pending asylum applications and valid Employment Authorization Documents (EADs). However, Kentucky currently limits REAL ID eligibility to U.S. citizens and lawful permanent residents, excluding many individuals who are legally present under federal law.

This policy places an undue burden on lawfully present residents who are contributing members of our communities, and it raises questions of fairness and equal treatment. Aligning Kentucky's policy with federal standards would help ensure consistency, support lawful residents in their day-to-day lives, and strengthen overall compliance with federal law.

I respectfully request that the Kentucky Transportation Cabinet:

1.     Review and update REAL ID eligibility criteria to include all individuals recognized by federal guidelines as lawfully present in the United States.

2.     Provide clear, updated guidance and training to DMV staff to ensure consistent implementation.

3.     Proactively communicate any changes to affected communities and stakeholders.

By taking these steps, the Cabinet can promote fairness, modernize its implementation of REAL ID, and ensure that all Kentuckians who meet federally recognized standards of lawful presence have equal access to identification services.
