Have you ever been forced into something you didn't approve of, agree with, or were unaware of? This was the reality for approximately 800 homeowners on July 2, 2025, when just five board member signatures adopted the Georgia Property Owner's Association Act. (see above)
Homeowners were furious, frustrated, and bewildered that the Walden Park 2025 board would make such a significant decision without prior notification and discussion with Walden Park homeowners, a thorough investigation of alternatives, or consideration for those who opposed the POAA. The board was well aware of the strong resistance from homeowners against this move, even knowing our names. Regrettably, rather than engage in meaningful dialogue, the board chose to impose a POAA on the community.
During the Walden Park Town Hall meeting on August 7, 2025, the primary question posed by residents to the board was, “Will you rescind this POA filing?” This straightforward inquiry was repeatedly raised by concerned homeowners.
The board has hired a new attorney without my prior knowledge, and to the best of my recollection, there was no introduction made during the meeting. The attorney quickly stood up and abruptly declared, “It cannot be rescinded.” This sparked a series of questions. Another homeowner asked, “Why not?” and the attorney replied, “It simply cannot be done without a 2/3 vote.” A different homeowner then exclaimed, “You didn’t require a 2/3 vote to file this POA?” Another resident asked each board member individually, “Will you rescind this POA filing?” Unfortunately, there was no response from the board members. The board president, Steven Jackson, swiftly stated, “The board will need to discuss this matter and get back to us.”
This Town Hall meeting was quite confusing to me! What is the answer to the question, “Will you rescind this POA filing?”
- First the attorney said the POAA filing cannot be rescinded at all.
- Then the attorney said the POAA filing cannot be rescinded without a 2/3 vote from homeowners.
- Then the board indicated a potential for rescinding the POAA filing since the board president stated they would discuss it and inform us of the outcome.
- Alternatively, the POAA filing can be rescinded, which aligns with Attorney Matos's belief and other legal professionals who are Walden Park resident.
That evening, we did not get a definitive answer to the question, “Will you rescind this POA filing?” I have a feeling we might not hear back from the Walden Park board. Nevertheless, I continue to hold onto hope that God will grant my prayer for the rescindment of the Walden Park POA.
