During the Walden Park Board Meeting on August 7, 2025, homeowners repeatedly echoed sentiments of mistrust, lack of communication, and hidden agendas by the board.  Such actions have undermined the transparency that was a cornerstone of the majority of the current board members' platform, during the 2024 Walden Park board election.

A lack of transparency results in distrust and a deep sense of insecurity.     Dalai Lama

The lack of transparency by the current board to pursue a POA is a downright kick in the ass and basic middle finger.     Attorney Matos and Walden Park Resident

Below is a letter from Attorney Matos that was sent to the Walden Park Board of Directors and property manager. This letter clearly explains lack of transparency and against POAA Walden Park.

NO GOOD DEED GOES UNPUNISHED

Based on the POA election letter issued by the board, it seems to many that the meeting scheduled for Thursday is not a meeting to discuss a change, but to discuss how we will accept an unacceptable and undemocratic decision.

As the attorney who helped fight back against the previous board's inappropriate overreach, I think it is important to comment on behalf of the valiant neighbors who took a stand and said, “Enough was Enough” in the Spring of 2024.

Several neighbors came forward last year as petitioners, witnesses and supporters for drastic change. These individuals provided their valuable time, names, signatures and unwavering support to change the course of leadership in our subdivision,

The lack of transparency by the current board to pursue a POA is a downright kick in the ass and basic middle finger.

A year ago many members of the HOA and residents of our community decided to fight back. The catalyst for the movement for change was that the previous board attempted to support an election to become a POA and then it was followed up with a bootleg attempt to steal an election. Most disheartening is that the successful election led to the installation of new board members.

From the beginning, I told each and every new board member that my service was pro-bono because I hate bullies and injustice and it is important for our children to see folk standing up for what is right.

Our efforts brought a great sense of pride in showing that we came together for a common cause and purpose and we were able to make a change and more importantly a new spirit of community was tapped.

If a POAA was the panacea, you had enough brilliant and informed folk in our community to formulate a limited plan of action. POA'S have been around since 1994 and what has it done to ensure that investment companies wouldn't infiltrate our subdivisions? NOTHING!!!!

Homeowners Associations (HOA) and Property Owners Associations (POA) laws are fundamentally based on contract law and can be customized or drafted to address the unique needs or conditions of Walden Park. If the board had concerns or pressing issues, why didn't you call for a meeting to discuss them and address those issues with the same people who advocated and supported the new board and all homeowners, who are also HOA members.

Under a POA law, the POA provides zero notice for the forfeiture on our neighbors’ homes. This practice is so inauthentic. If you recall, the old board hid behind the idea that they could not be thrown out because of a lack of legal notice. Yet, we are going to circumvent the notion of proper notice and due process as it relates to current homeowners and more importantly HOA members. Can the board explain how a non-judicial foreclosure will decrease or prevent the number of investors in Walden Park? Has a board member ever attended a property sale on the First Tuesday of every month at the courthouse steps?

Furthermore, during our litigation, we also discovered that the financial records were in chaos. If you recall, we had testimony last year where a homeowner had paid their assessments and their check sat in a mailbox all winter. Many of our residents have to keep records and canceled checks in order to avoid double billing and overcharges.

I hope to God this meeting is not simply to placate hard-working, grown folk homeowners. We voted and litigated that insulting practice out of office in November, 2024.

If the election for the POA was filed, I would suggest that it be withdrawn and allow the homeowners an opportunity for actual input and not mere theatre.

Respectfully

/s/William A Matos Attorney
