After Musk’s PAC Sent Prefilled Ballot Applications, Strengthen Georgia’s Election Laws
The Issue
Georgia voters deserve elections that are transparent, lawful, and free from improper interference.
In 2024, Georgia’s Secretary of State opened an investigation after residents reported receiving partially prefilled absentee ballot applications from Elon Musk’s America PAC. According to findings presented to the Georgia State Elections Board, state law prohibits third parties, other than authorized relatives, from sending absentee ballot applications prefilled with required voter information.
The board ultimately voted to issue a formal letter of reprimand to America PAC.
But a letter is not enough.
Election laws exist to protect voters from confusion, coercion, and unauthorized handling of ballot materials. When political groups send prefilled absentee ballot applications, it risks undermining public trust and blurring the line between official election materials and partisan campaign efforts.
Georgia must respond with stronger enforcement and clearer statutory protections.
This petition calls on the Georgia State Elections Board, the Georgia Secretary of State, and the Georgia General Assembly to:
- Impose meaningful penalties for violations involving prefilled absentee ballot applications
- Clarify and strengthen state law to explicitly prohibit political committees from sending prefilled ballot materials
- Require conspicuous, standardized disclaimers on all election-related mailings
- Ensure enforcement mechanisms deter future violations
Election integrity should not be partisan. Whether the violation involves a Republican or Democratic group, the law must apply equally.
Georgia was a key battleground state in 2024. That makes compliance even more critical. Voters must be confident that absentee ballot processes are not manipulated by outside political interests.
A reprimand acknowledges wrongdoing. Stronger enforcement prevents it from happening again.
