My son is currently living with schizoaffective disorder and is facing an unjust sentence of 25 years to life without the possibility of parole. His charges stem from an incident where he allegedly shot a gun up in the sky. Nobody was injured. However this was labeled as attempted capital murder, despite the absence of intent and his struggle with severe mental illness. This is not just a singular issue; it represents a broader problem with our criminal justice system, which often does not account for mental health conditions. It's crucial to recognize that mental health disorders like schizoaffective disorder impair judgment and decision-making, contributing to actions that, in a healthy state, might never occur. Rather than incarcerating those with mental health issues, we should be advocating for mental health courts and long-term, appropriate mental health care facilities that understand the unique challenges faced by individuals like my son. Mental health courts have shown significant success, reducing recidivism and providing tailored treatment that acknowledges the reality of living with mental illness. According to the Treatment Advocacy Center, over 20% of those incarcerated have a serious mental illness. The prison environment is not equipped to handle these cases, often leading to worsening conditions and lost potential for rehabilitation. Furthermore, mentally ill inmates are more likely to face abuse and neglect within the prison system, which can exacerbate their conditions and increase the burden on taxpayers without addressing the root cause of their actions. We need a more humane and effective approach to dealing with mental health in the criminal justice system. I urge lawmakers, judges, and mental health advocates to support the implementation and expansion of mental health courts and ensure access to long-term care for those who need it most.
