Adoption of Open Spaces from Persimmon by the Local Authority (Redditch Borough Council)

The Issue

NOTE: No financial request is being made.  No money is required.

This affects 3500 residents covering 11 open spaces within the Brockhill estate.

In excess of £500,000 (excluding any interest that may be owed) is due to be payable to Redditch Borough Council (RBC).

The adoption of these open spaces is long overdue, and some, for 13 years.

They come under the Town and Country Planning Act 1990 (1990 c. 8 Part III Other controls over development Section 106).  RBC have the power to enforce these agreements.

24th October 2018 the RBC legal department replied to me: “We are aware of the enforcement options but don’t believe that we are quite there yet.”  Allegedly, this had been going on prior to 2012!  We are in June 2023, and no enforcement is known to have taken place.

The councillors involved have felt equally frustrated, even the leader of the council. 

31st October 2019 (Redditch Standard) - “The long running saga over outstanding money owed to Redditch Borough Council by Persimmon Homes may finally becoming (sic!) to an end.”  Big fanfare from Rachel Maclean.

The last word on the subject came on the 24th October 2022, that the matter was now with Land Registry.  However, it was alleged that Persimmon had made incorrect submissions relating to the actual open spaces.  The has not been corroborated.

I’d like this petition to be sent to our local MP (Rachel Maclean) now, to see if she can intervene once again and get to the bottom of the problem and actually get some true traction rather than mere headlines.
