The Issue
The family court system in Scotland is currently falling short in protecting children and victims of domestic abuse. This lack of safeguarding is leaving many individuals vulnerable and exposed to further harm, which is not only a legal oversight but also a moral failure.
Numerous studies and testimonies from affected families reveal that decisions made in family court often disregard critical evidence of abuse, resulting in custody and visitation arrangements that are harmful to the most vulnerable. According to recent statistics, a significant number of children and domestic abuse survivors suffer due to inadequate legal protection during and after separation or divorce proceedings. These failures have contributed to a cycle of abuse that the legal system should be interrupting, not perpetuating.
The core of the problem lies in the inconsistency and lack of awareness among family court officials about the dynamics of domestic abuse and its impact on children. Furthermore, systemic biases and outdated practices often lead to decisions that prioritize parental rights over the safety and well-being of children and abuse survivors.
We urgently call upon the Scottish Government and judicial authorities to initiate a comprehensive review and reform of the family court system. This includes mandating specialized training for judges and court staff on domestic abuse, implementing stricter guidelines for evaluating evidence of abuse, and prioritizing the protection of children in all court proceedings.
To ensure lasting change, we also propose the establishment of an independent oversight body that will monitor family court proceedings and decisions to safeguard children and survivors of domestic abuse effectively.
