The Issue
Too many pregnant women in America — especially Black women — are being dismissed, sent home, and denied lifesaving care during labor.
The recent story of Mercedes Wells, who was discharged from a hospital while in labor and gave birth in her car just minutes later, is horrifying but not unique.
We must act now to protect all birthing people from negligent and unsafe discharges.
Congresswoman Robin Kelly has introduced the WELLS Act (Women Expansion for Learning and Labor Safety Act) to require hospitals and medical facilities to provide a safe discharge plan before releasing any pregnant patient presenting signs of labor.
This plan would include:
- Clinical justification for discharge
- Assessment of travel time and distance
- Written confirmation that the patient understands their status
- Required physician examination before discharge
- Mandatory racial bias and cultural competency training for staff
This bill is essential to improve maternal health outcomes and hold hospitals accountable for systemic failures that put lives at risk.
We urge Congress to pass the WELLS Act immediately and protect the safety and dignity of pregnant women across the country.
