Improve pedestrian safety at Las Animas Elementary

The Issue

Andrew Stuart and Stacia Stuart were not just victims of a tragic accident.
They were my family. They were loved. They were vibrant. They were someone’s whole world.

They were walking in the crosswalk behind Las Animas Elementary School — a place meant to be safe. A place where children walk every morning with backpacks and parents hold little hands. A place our community trusts.

And in an instant, everything changed.

They were killed by a teenage driver in a crosswalk that did not have adequate safety measures. A crosswalk used daily by students, families, teachers, and neighbors. A crosswalk that sits in the heart of a busy neighborhood.

I replay that reality over and over in my mind.
A marked crosswalk.
Behind an elementary school.
And still… it wasn’t enough.

Andrew and Stacia did everything right. They were where they were supposed to be. And they paid with their lives.

I started this petition because I cannot sit quietly in this grief. I cannot accept that this is simply “how things happen.” I cannot accept that we wait for tragedy before we act.

Flashing crosswalk lights are not extreme. They are not unreasonable. They are proven to dramatically increase visibility and reduce pedestrian accidents. They alert drivers. They create awareness. They buy seconds — and sometimes seconds are the difference between life and death.

To our city leaders, council members, and decision-makers:

How many tragedies does it take before prevention becomes a priority?
How many families have to stand at a gravesite before safety is addressed?

This crosswalk serves hundreds of children every single day. Parents should not have to feel fear when their child walks to school. Families should not have to wonder if the painted lines on the road are enough to protect them.

Andrew and Stacia cannot be brought back. Nothing will change that.

But their deaths must mean something.

We are asking you — respectfully but urgently — to prioritize the installation of flashing crosswalk lights at this location. 

This is not about blame.
This is about responsibility.
This is about preventing another phone call that shatters a family forever.

If one life is saved because visibility improved… if one child makes it home safely because a driver saw flashing lights in time… then this fight matters.

I am heartbroken that this tragic accident took place, my office is here to provide any support needed, and my thoughts are with the family involved. If there are any resources the community needs please let me know so that I can connect you with them. My wife and I are parents that walk and bike the streets to our schools too. Traffic safety citywide and near schools is something that I have always worked on to improve and draw attention too, but we continue to have near misses and tragic accidents like this. As a Council Member that doesn't live in the Las Animas Elementary district I do not automatically receive any information from Home and School Club meetings as well as School Site Council meetings. I am not aware of any actions that have been taken around Las Animas Elementary to increase safety besides the regular paving projects where we purposefully reduce lane widths to reduce speeds, provide enhanced striping to call out crosswalks around our schools, extend curbs to bulb out, adding green bike lanes around known bike/ped/vehicle conflict areas, and extra signage. As mentioned in the petition Rapid Flashing Beacon crosswalks are a great tool as well. I am open to any suggestions and working with anyone to reduce speeds and prevent tragic accidents like this from occurring. I recommend that you include, advocate, and engage with GUSD Trustee Area 7 Tuyen Fiack who represents Las Animas Elementary School and the surrounding area on the GUSD School Board. While you won't directly elect someone to your District until 2028, current Council Member Kelly Ramirez lives in your District, and I highly recommend that you advocate and engage directly with her as well. That is a great place to share your advocacy during open public comment. Every single road and intersection that's designed and redesigned is required by state law and our local laws to be designed with a Complete Streets overlay. Many of those recommended actions in our Complete Streets approach I mentioned above were taken in this neighborhood around Las Animas Elementary. We are currently developing a Comprehensive Roadway Safety Action Plan and Local Roadway Safety Plan too. Gilroy uses a complete streets approach to the design of its transportation network. Complete streets are designed for all users in mind, including those of varying abilities, and may include sidewalks, bicycle lanes, dedicated transit lanes, and safer intersections. Careful planning and coordinated development of complete streets infrastructure can improve public health by encouraging active lifestyles and improving roadway safety. This guides the overall provision of a balanced multi-modal system of transportation facilities and services in Gilroy serving all users. Provide safe, consistent, and convenient travel along and across streets to serve all users, including pedestrians, the disabled, bicyclists, motorists, movers of commercial goods, and users and operators of public transportation. The city also is currently receiving bids to develop a Comprehensive Roadway Safety Action Plan which will create a framework for the City to systematically analyze and identify traffic safety issues and develop a prioritized traffic safety improvement list utilizing data-driven best practices, local agency partnerships and collaboration, and stakeholder/community feedback. A Local Roadway Safety Plan (LRSP) is a requirement for the City to apply for Highway Safety Improvement Program funding in the future. The City was selected to receive grant funding to develop an LRSP with a total budget of $237,500. On July 1, 2024, the City received a funding allocation through the Safe Streets 4 All grant, which authorized City staff to move forward with the project. The LRSP will be a risk-based, data-driven, and collaborative effort. The LRSP should align with relevant existing City plans, Caltrans’ Strategic Highway Safety Plan (SHSP), and the Safe Systems approach as defined by the Federal Highway Administration. The LRSP will engage with key stakeholders and the community; collect and assemble relevant data; conduct collision and roadway analysis; identify emphasis areas and countermeasures; create a prioritization methodology for traffic safety projects; identify and prioritize potential projects; and develop a funding, implementation, monitoring, and evaluation plan. The outcome of this effort will be a living document that will help the City evaluate traffic safety issues, prioritize resources, pursue funding, and achieve the goal of improving traffic safety.
