Abolish the School to Prison Pipeline
The Issue
In various states such as the state of Kentucky in the U.S., there are numerous local school districts under the oversight of State Departments of Education that continue to fail to intervene and/or deprive students of procedural due process subject to suspension, expulsion or transfer to alternative schools while procedural due process is blatantly disregarded and violated.
In the state of Kentucky, procedural due process requires a hearing in front of your local school board or an appeals committee prior to suspension, expulsion or transfer of a student to alternative schools per KRS 158.150 .
However the Kentucky Department of Education is currently either not scheduling a hearing at all or hosting administrative hearings contradictory to state law and local policy. Additionally, the Kentucky Department of Education is fabricating documents that claim that students have been granted procedural due process through a hearing in front of the board while the truth remains that many of us never have.
We the people demand reform and immediate reinstatement of the United States Department of Education Office of Civil Rights that retained the authority to enforce reform prior to un-informed executive orders by President Trump.
Contrary to the un-informed signed executive order by President Donald Trump on March 20, 2025, eliminating oversight of state departments of education by pivotal departments of the government such as the United States Department of Education: Office of Civil Rights, the executive order signed by President Trump on March 20, 2025 will further enable The Kentucky Department of Education and other states alike to continue to cause irreparable harm to individual students equal access to a public education through fabricated documents and ongoing conspiracies to infringe upon students right to procedural due process.
The executive order signed by President Donald Trump on March 20, 2025 will achieve the exact opposite of what it claims to do and the time to act is NOW.
President Trump is a person with privilege that has erroneously assumed he is helping those without it by signing executive orders that have only had the effect of enabling a failing system versus fixing it.
The Kentucky Department of Education and other state departments alike have been and continue to historically fail to intervene in the deprivation of equal access to a public education while forcing students into the school to prison pipeline.
Alternative schools not only fail to meet academic standards but additionally provide an environment optimal for failure.
As funding for public education systems continues to plummet, prison stock in Kentucky continues to rise.
Help us disappoint the surplus amount of Investors in Prison Stock by helping take another step towards abolishing the school to prison pipeline by signing this petition to help secure our only means of recourse in the peaceful exercise of our 1st amendment right to petition the government through complaints submitted to the United States Department of Education: Office of Civil Rights.
The United States Department of Education: Office of Civil Rights retained the jurisdiction to enforce civil rights prior to the executive order signed by President Trump on March 20, 2025.
Black and African American students are targeted and held to a more stricter standards statistically than students of other races where black and/or African American students in Kentucky grades K-12 are deprived of an education at their public common school 2x more than any other race.
This petition is created to generate and provide an undisputed record of public interest and/or impact this school to prison pipeline epidemic has caused within the state of Kentucky but not limited to the state of Kentucky.
The executive order signed by President Donald Trump on March 20, 2025 completely severed a class of individuals only recourse to petition the government through the United States Department of Education Office of Civil Rights where our lead plaintiff was assigned an investigator 10 days prior to the executive order on March 10, 2025.
Our lead plaintiff, Tanyqua Oliver has officially filed for preliminary injunctive relief against President Donald Trump’s Executive Order signed on March 20, 2025 as this petition has reached 150 signatures in high hopes that the United States Department of Education: Office of Civil Rights may complete their investigation initiated by our lead plaintiff to mitigate irreparable ongoing injuries to a class of individuals rights to procedural due process.
