Abolish 'as is' warranties on cars in Alabama

The Issue

On October 11, 2025, I purchased a vehicle from Exclusive Auto Sales, and within a few hours, it wasn't running anymore. When I returned to seek resolution, they unjustly blamed me for the issue, even going as far as deflecting the responsibility in a Better Business Bureau (BBB) response. I am not alone in this battle against 'as is' warranties that leave consumers financially stranded and without recourse in Alabama.

Many car buyers in Gadsden, AL, and across the state face similar distressing situations, where the purchase of a vehicle quickly turns into a nightmare. These 'as is' warranties protect deceptive dealerships, leaving customers unprotected against malfunctioning vehicles, essentially transferring all risk onto the buyer. According to the Federal Trade Commission, most states have lemon laws to protect consumers; however, Alabama's protections remain alarmingly lax, allowing these predatory practices to continue unchecked. This needs to change.

The consequences of these policies are far-reaching. Families in our community are drained of their financial resources, faced with unexpected repair bills that stretch their budgets thin or force them into debt. As citizens of Gadsden who believe in fairness and consumer rights, we can no longer stand by while car dealerships exploit legal loopholes to profit at our expense.

We propose that Alabama legislators reconsider and legislate stronger consumer protections against 'as is' sales. This could include mandatory disclosures about car conditions, increased penalties for deceptive sellers, or even abolition of such predatory warranty clauses altogether. Such actions will align Alabama's consumer protection policies with those of other states, reducing the burden on vehicle buyers and ensuring a fairer market.
