We, the undersigned citizens of the United States—farmers, entrepreneurs, consumers, veterans, and innovators—stand united against the shadowy provision slipped into the Continuing Appropriations Act of 2026 (Section 781), which threatens to dismantle a thriving industry built on the promise of the 2018 Farm Bill. This so-called "hemp bill," signed into law on November 12, 2025, under the guise of averting a government shutdown, imposes a draconian THC cap of just 0.4 milligrams per container, effectively banning 90-95% of hemp-derived products, including non-intoxicating CBD remedies that millions rely on for pain relief, anxiety management, and everyday wellness.
What began as a bipartisan triumph—Mitch McConnell's vision of hemp as a new economic powerhouse for rural America—has been twisted into a prohibitionist trap. This ban, set to take effect on November 12, 2026, endangers over 100,000 jobs, imperils a $28 billion market, and invites a black market resurgence rife with untested, unregulated dangers. Kentucky's fields, once heralded as the cradle of industrial hemp revival, now face mass layoffs and shuttered farms. Veterans using CBD for PTSD, patients easing chronic pain without opioids, and small businesses innovating sustainable textiles, biofuels, and nutraceuticals—all stand to lose.
We reject this overreach, born not of debate but of last-minute maneuvering that forced lawmakers to choose between funding our military and preserving economic freedom. As Rep. Nancy Mace declared in introducing the American Hemp Protection Act of 2025, "Rather than adopt common-sense regulations, prohibitionists imposed a national ban." We echo Sen. Rand Paul's floor speech: This overrides state frameworks, silences consumer choice, and destroys livelihoods without a fair hearing.
We Demand the Following:
Immediate Repeal of Section 781: Support and pass the American Hemp Protection Act of 2025 (H.R. [pending]) to strike the ban entirely, preserving the 2018 Farm Bill's definition of hemp as any cannabis derivative with less than 0.3% delta-9 THC.
Robust Federal Regulations, Not Bans: Direct the FDA to issue guidelines within 90 days for age restrictions (21+), child-resistant packaging, clear labeling, and third-party testing—empowering safe innovation while protecting youth and ensuring product integrity.
Economic Safeguards: Provide transitional funding and tax incentives for hemp farmers and businesses to pivot without collapse. Recognize hemp's role in rural revitalization, sustainable agriculture, and reducing opioid dependency—benefits backed by USDA data showing hemp's potential to generate $25 billion in new revenue by 2030.
Bipartisan Farm Bill Reforms: Accelerate the 2026 Farm Bill to modernize hemp policy, closing exploitative loopholes while fostering a regulated, interstate market that benefits all 50 states.
