A Call for Legal Action against Fiona Muir Harvey in obtaining a Custodial Sentence

The Issue

This petition is an appeal to Richard Gadd, Laura Wray, and Prime Minister Sir Keir Starmer to pursue a custodial sentence against Fiona Muir Harvey, the known serial stalker. It is believed that there is now substantial evidence available that can lead to a solid criminal conviction. Not acting against such a person can potentially put other individuals at risk of becoming victims, and, going on the current evidence, it has done. We plead to the mentioned authorities to uphold their Duty of Care to future victims.

Harvey is currently suing Netflix over the series "Baby Reindeer" on what we believe is a technicality. Despite extensive evidence of stalking abuse and harrassment of her victims, including emails presented in the California court case, Harvey has never been convicted for her crimes, leading to a significant failure in the justice system that has allowed her to continue stalking and traumatizing numerous victims for over three decades. It is clear that whatever mental heath interventions, written warnings, and judicial attempts at stopping her from stalking in the past have not worked, as more and more of her victims come to light.

Statistics show that 1 in 6 women and 1 in 19 men will experience stalking in their lifetime, often resulting in long-lasting trauma. Stalking victims are at higher risk of severe psychological distress, including anxiety, depression, and PTSD. The impact of such crimes cannot be overstated, with many victims suffering from ongoing fear and disruption to their lives.

Our concern, as the undersigned, is that if Harvey wins any part of her $170 million lawsuit, it will validate her stalking behavior and reward her criminal activities. This substantial sum could enable her to continue harassing and abusing more victims, and with impunity. We cannot accept this outcome.

Moreover, such a precedent could make stalking seem financially rewarding, deterring victims from coming forward for fear of legal retaliation if they make any factual errors about their stalker alongside their very real evidence. It would set an example that stalkers could monetise their abuse to further attack their victims if they try to tell their story.

Richard Gadd's play only exists because of the four years of abuse he suffered at Harvey's hands—a situation she created through her relentless stalking, affecting not just Gadd but also Laura Wray, Jimmy Wray, Donald Dewar, Janey Godley, George Galloway, Sir Keir Starmer, and countless others.

Therefore, we believe it is the duty of those who have been affected, but have failed to act previously in pursuing a custodial sentence, possibly due to trauma bonding or sympathy for their abuser, to now act in accordance with the findings of the criminal review as submitted by Louise Michelle Oakley. Ensuring Harvey is finally punished for her crimes is imperative to protect future victims and to uphold justice.

In relation to the case in the California between Fiona Harvey and Netflix, special advisor Louise Michelle Oakley, Senior Treasury Counsel of the Law Officers OF England and Wales, was asked to review the case and evidence in line with the Current Legislation on Stalking. 

Her expert findings were, based on reviewing the evidence, on the charge of stalking Richard Gadd : 

“Fiona Harvey’s culpability would be assessed as being very high due to the extreme nature of her conduct, the persistence of her conduct, and the period over which her offending took place, and the harm caused to Richard Gadd would be placed within category 1. Fiona Harvey’s conduct caused very serious distress to Richard Gadd and caused him to make considerable changes to his lifestyle to avoid contact. The grossly violent and offensive material sent by Fiona Harvey would be an additional aggravating factor. As a result, the starting point for a single offence would be 5 years imprisonment with a category range of 3 ½ years - 8 years custody.”

And, upon reviewing the evidence, on the charge of sexual assault on Richard Gadd, her expert findings were:

“It would not be in the interests of justice for a court to follow the sentencing guideline for sexual assault. The relevant factors set out in the Guidelines do not adequately reflect the culpability of Fiona Harvey and/or the harm caused to Richard Gadd on the particular facts of this case. Fiona Harvey did not commit one single sexual offence. She committed multiple incidents, over a number of months. While the touching was over clothing, it was committed while Richard Gadd was working, in front of work colleagues and other members of the public. In addition, Fiona Harvey's offending caused very serious distress to Richard Gadd that affected his mental health and involved additional degradation and humiliation. In my opinion, the repeated nature of Fiona Harvey's conduct passes the custody threshold and a sentence of up to 2 - 3 years custody may be appropriate for this offence.”

Given these statements, we feel there is a need in the best public interest to pursue a custodial sentence to further protect both existing victims who are too afraid to come forward, as well as any future victims of Harvey. We believe future victims of Harvey may be widespread, should she gain the financial winfall from her lawsuit, which would both validate her actions, and enable her to continue stalking her victims with impunity.
