We, the undersigned, are writing to formally petition the Federal Motor Carrier Safety Administration (FMCSA) and the United States Department of Transportation (USDOT) to take immediate and comprehensive action against a troubling trend of non-compliance and unethical practices among certain trucking companies operating in the Chicago Metro area. Companies such as Super Ego Holdings, MN89, Kavkaz Express, Zazulyak Trucking, Vlasimir Trucking, Express Inc, and Ukraine Express have repeatedly demonstrated a disregard for safety regulations, endangering both their drivers and the general public.
The issues we face are multifaceted and include:
1. **False Logs**: Many of these companies have been found to manipulate driver logs, violating Hours of Service regulations and compromising road safety.
2. **Safety Violations**: Consistent non-compliance with federal safety standards has been documented, raising serious concerns about the safety of their operations.
3. **Coercion Towards Drivers**: Drivers are often pressured into violating safety regulations, including driving beyond legal limits and neglecting necessary rest periods.
4. **Non-Domiciled CDL Drivers**: The employment of non-domiciled commercial driver's license (CDL) holders raises significant questions about the qualifications and training of these drivers.
5. **Predatory Leasing Practices**: Many of these companies engage in predatory leasing practices that exploit drivers, leading to financial instability and unsafe working conditions.
Despite the potential for government agencies to take action, we are concerned that these companies may simply rebrand themselves under new names or USDOT registrations to evade accountability. For instance, Super Ego Holdings operates under seven different names and registration numbers, all while being technically owned by a single individual. This practice not only undermines regulatory efforts but also perpetuates a cycle of unsafe operations.
To address these pressing concerns, we urge the FMCSA and USDOT to implement the following measures:
- **Strengthen Regulatory Framework**: Develop a more robust regulatory framework that prevents companies from evading accountability through name changes or new registrations. This could include a centralized database that tracks ownership and operational history across multiple registrations.
- **Conduct Comprehensive Investigations**: Initiate thorough investigations into the practices of the aforementioned companies and others like them to ensure compliance with federal regulations.
- **Enhance Oversight and Monitoring**: Increase oversight and monitoring of trucking companies operating in the Chicago Metro area to prevent the proliferation of unsafe practices.
- **Promote Transparency**: Require companies to disclose their safety records and compliance history to the public, fostering accountability within the industry.
