2 Credits Away: Student withAutism Denied His Senior Year — Demand Fairness for All Studen

The Issue

My son began his journey in Buchanan County Public Schools in the sixth grade, facing many social challenges due to Autism Spectrum Disorder (ASD).

Over the years, he worked incredibly hard to find his place. He built meaningful friendships, gained confidence, and was supported by teachers and staff who recognized his strengths and helped him grow. He has never been in trouble.

He has consistently been on the honor roll and Principal’s List. He is a member of Beta Club and even served as the school mascot.

He is only 2 credits away from graduating.

After our family was forced to relocate due to flooding and housing displacement, my son was denied the opportunity to return for his senior year — simply because he was considered out of district.

We were not asking for transportation. We were willing to provide that ourselves.

Despite his academic record, his progress, and his disability, he was denied both in-person attendance and the option to complete his final credits online.

Meanwhile, other out-of-district students have been allowed to attend Buchanan County schools or complete coursework online under similar or related circumstances.

This raises serious concerns about fairness and consistency in how policies are applied.

I have attempted to address this through the proper channels:
• I contacted the school directly  
• I requested reconsideration  
• I submitted multiple FOIA requests — which remain incomplete  
• I attended a school board meeting to speak publicly but was not allowed to speak during public comment  

The matter was instead taken into closed session, and I have not received clear answers.

Due to the lack of transparency and incomplete responses, I have:
• Filed a complaint with the Virginia FOIA Advisory Council  
• Filed a formal complaint with the Virginia Department of Education  

I have also formally requested a review and investigation into how this decision was made.

This is no longer just about one student.

This is about transparency, accountability, and whether policies are being applied fairly and consistently to all students — especially those with disabilities.

Education should support students, not create barriers that disrupt their progress and well-being.

Students deserve stability, understanding, and equal opportunity. Families deserve to be heard.

We are asking for:
• Transparency in how these decisions are made  
• Accountability in how policies are applied  
• Fair and consistent treatment for all students
