

Demand Marsy’s Law be upheld in San Bernardino County
The Issue
Several years ago, I had to turn to Change.org for help in ensuring the safety of myself and my daughter during a domestic violence case. Back then, it felt like my only hope, and sadly, it seems little has changed. The same defendant, who once posed a danger to us, has been caught with deadly weapons but is still roaming free, in blatant violation of his probation. To make matters worse, the discovery was left to me—no notification was sent to safeguard my daughter and me.
In the pursuit of safety and concealment, I've uprooted my life. I moved states and switched careers from a librarian to working in fast food. It's been a struggle, to say the least, having encountered several precarious situations. My daughter, once carefree, is now being homeschooled as a precaution. Her childhood, turned upside down, is scarred by the necessity to stay hidden.
Marsy’s Law was enacted to protect victims like us, yet it's exceedingly clear that San Bernardino County is not upholding these laws. Marsy’s Law grants victims numerous rights, such as the right to be notified of major developments in the criminal process and the right to be reasonably protected from defendants. In this case, it has sadly failed.
Without adherence to Marsy’s Law, victims like me continue to live in fear and insecurity. I am calling on San Bernardino County officials, law enforcement agencies, and the judicial system to live up to their commitments under this law. Enforcing Marsy’s Law means enforcing the notification of victims about the changes in the status or custody of offenders and ensuring they have a voice in the process.
This critical law empowers victims and prioritizes their safety, yet when its directives are not followed, we are left vulnerable. It’s time for San Bernardino County to take a stand, to commit to bolstering victim support and to ensure that Marsy’s Law is not just a promise, but a practice.
We cannot let this oversight continue.
