The Issue

Anecita Rojo is innocent of the charges filed against her by military forces in Negros Occidental.

She was nabbed by police intelligence operatives last December 7, 2012 without any warrant of arrest and was dragged out of a Church convent in Bago City.

She and more than 50 others were charged for the death of Lt. Archie Polenzo during an encounter between the NPA and the military on March 7, 2010.

The Office of the Chief Justice, through lawyer Ma. Lourdes Oliveros, chief-of staff of Chief Justice Ma. Lourdes Sereno, has already referred last February 12, 2013 the case of Rojo to Justice Sec. Leila De Lima for appropriate action while Commission on Human Rights chairperson Rosetta Ann Rosales was also furnished a copy of the letter.

In the light of this development, we request Secretary De Lima to hasten the dropping of charges against Rojo especially after Cadiz City Regional Trial Court Judge Renato Muñez has ordered the Cadiz City Prosecutor's Office to conduct a reinvestigation into the case.

We ask Secretary De Lima to order the immediate dropping of the charges since we believe that the case against Rojo is not in the interest of justice but a persecution of non-government and development workers who are working for the poor and the disadvantaged.

We also ask Chairperson Rosales to order a moto proprio investigation into the malicious prosecution of Rojo, development worker Zarah Alvarez and all others whose only crime, if it can be considered a crime, is to tirelessly work for and push for genuine social change.

This is a large-scale violation of human rights and we ask Rosales and her office to take a firm stand so that those who use the law to commit crimes against freedom and justice will be held to answer.
