The Issue

WHEREAS, fraternities at the University of Tennessee (the "Fraternities" and "UT") have an admirable history of fundraising for charitable causes ("Philanthropy Events"); and 

WHEREAS, the charitable causes for which the Fraternities have raised hundreds of thousands of dollars by means of their Philanthropy Events include such charities including: St. Jude Children’s Hospital, The Jason Foundation, and Children’s Miracle Network, Big Brothers and Sisters of Knoxville, Ace Miller Foundation, Push America, Juvenile Diabetes Research Foundation, Camp Koinonia, Fisher House Foundation, and East Tennessee Children’s Hospital (the "Charitable Causes"); and

WHEREAS, the Charitable Causes for which the Fraternities have raised substantial sums by means of their Charitable Activities rely on the contributions made by and through the efforts of the Fraternities; and

WHEREAS, some members of the Fraternities occasionally engage in behavior which is not becoming to young University men; and

WHEREAS, the unbecoming activities of the Fraternities occasionally cause them to be placed by the administration of UT on what is known as "Disciplinary Probation"; and

WHEREAS, as Disciplinary Probation is presently administered by UT, when one of the Fraternities is placed on Disciplinary Probation, it is precluded from holding, participating in, and donating to Philanthropy Events; and 

WHEREAS, the undersigned petitioners believe that is harmful not only to the members of the Fraternities and, in particular, the Charitable Causes, for Disciplinary Probation to include a prohibition against engaging in Philanthropy Events, in that it deprives not only the members of the Fraternities responsible for their fraternity being placed on Social Probation, but also the non-offending members, and discourages them from engaging in behavior which is positive and benefits not only the Charitable Causes, but UT and its students,

NOW, THEREFORE, the undersigned petitioners respectfully ask that UT not prohibit Fraternities, which are placed on Disciplinary Probation, from holding, participating in, and donating to Philanthropy Events.
