West Gate Housing Society Management Committee had extorted unlawfully money from its law abiding residents as voluntary donations in lieu of giving them No objection certificate( NOC) when they bought the flats on resale. As per the regulations, Rs 25,000 can be charged from the residents towards transfer of flat. But the society management committee had charged ranging from Rs 1 lakh for 2BHK and 1.75L for 3BHK flats as additional in the form of voluntary donations. Without the donation paid, buyers were not issued NOC. Most of the buyers took home loan. Which buyer would pay such big voluntary donation amount with a home loan liability? This petition is to request WGHS to refund the donation amount immediately. On non cooperation, Govt authorities to direct the WGHS society to refund the amount to its respective residents immediately.
