The House Subcommittee on Health, Employment, Labor, and Pensions is a standing subcommittee within the United States House Committee on Education and Labor. It was formerly known as the Subcommittee on Employer-Employee Relations.

The subcommittee has jurisdiction on employment-related health and retirement security, including but not limited to pension, health, other employee benefits, and the Employee Retirement Income Security Act.

The subcommittee has 16 Representatives and half are not cosponsors of H.R. 82, Social Security Fairness Act. The House Subcommittee on Health, Employment, Labor and Pensions are guided by rules set in place by the Employee Retirement Income Security Act of 1974. (ERISA) is a federal United States tax and labor law that establishes minimum standards for pension plans in private industry. The Representatives that are not cosponsors of H.R. 82 must believe that once the same workers are retired and if affected by WEP and GPO their Social Security benefits should be below the minimum standards as non affected workers.

More than 2.5 million people dedicated to public service, including many educators, have their Social Security benefits reduced—or lose them entirely—due to the Windfall Elimination Provision (WEP) and Government Pension Offset (GPO). 
The WEP reduces the Social Security benefits of people who work in jobs covered by Social Security and jobs NOT covered by Social Security over the course of their careers—for example, educators compelled to take part-time or summer jobs to make ends meet. 

The GPO reduces the Social Security spousal or survivor benefits of people who get a government pension (federal, state or local) but did NOT pay Social Security taxes themselves. 

The reduction of Social-Security benefits, that can be as much as $512 or survivor benefits being total eliminated in some cases. Representative Mike Johnson of Louisiana calls the legislation criminal.
