In pursuit of brevity, below are extracts from two emails reflecting a complete disconnect in the responsibilities between the Ministry of the Attorney General (responsible for the LTB) and the Ministry of Municipal Affairs and Housing with respect to the responsibility for change in LTB processes and adjudication.

The first email is from the LTB Registrar Lindewe Bridgewater to the me (petition author), dated 2024 04 08, stating that the auto-evict petition objective falls under the mandate of the Ministry of Housing.

The second email is from a ghost writer at the Ministry of Housing who identifies themselves (unprofessionally) only as "The Residential and Commercial Tenancies Unit, The Ministry of Municipal Affairs and Housing" to MPP Ted Arnott, stating that the Ministry of Housing can’t interfere with  the LTB.

No one appears to be taking ownership or responsibility for the LTB’s systemic failure to return possession of a property to its rightful owner immediately after the non-rent-paying tenant has breached their government-authored tenancy agreement.

The relevant paragraph from the LTB email states, "The LTB can only address input related to its mandate of administering the RTA. The proposed changes in this petition relate to the legislation which falls under the jurisdiction of the Ministry of Municipal Affairs and Housing."

The relevant paragraph from the MoH email states, "The Landlord and Tenant Board (LTB) is the adjudicative tribunal with the authority to resolve disputes between landlords and tenants. To preserve the independence of the LTB, government officials are not permitted to interfere in, or comment on, tribunal processes or decisions."

UPDATE ON PETITION AND NEXT STEPS

The Durham Landlords Association (DLA) asked me to be a guest speaker at their next meeting on Tuesday, May 14th starting at 7 pm at Keller Williams Energy Brokerage, 285 Taunton Rd E, Oshawa, ON

I'll be updating attendees on the current status of the petition, the two significant meetings that occurred very recently that could result in an outcome at the LTB that we've all been asking for, but I'm only cautiously optimistic. If that happens before this DLA meeting, then I'll be discussing whatever that outcome is.

I'll also update you on the newly-formed petition committee comprising nine volunteers, including me. One of the pivotal questions is whether to form yet another new association. With 39,000 prospective members or at least legal and advertising fund contributors, there's a unique opportunity to create a single compelling voice for the small-to-medium housing provider industry that hasn't existed for a long time, if ever.

I'll be there by 6:30 pm.
