The all-out assault of the Israeli Defense Forces (commonly known as the Israeli Occupation Forces) on Gaza has been live-streamed for almost two years, each day revealing new atrocities committed under order of Prime Minister B. Netanyahu and his war cabinet .
Citizens of the world have repeatedly pleaded with their governments to intervene, but nothing has changed. We have petitioned our governments, we have demonstrated peacefully, we have encouraged our fellow citizens to boycott Israel, private stakeholders to divest from investing in Israel and our called upon our states to sanction Israel. Some have even engaged in civil disobedience and direct action. Instead, all steps citizens have taken have been met either with contempt, or with lies (where certain states still supply military equipment to Israel or sanction the shipping thereof, despite publicly condemning the acts of the Israeli state), or with brutal repression (such as by the police force in Berlin, Germany), arrest and in some cases, imprisonment (such as in the UK, where holding a simple placard is now considered an act of terrorism, and punishable as such).
The UN's own Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967, Francesca Albanese, has concluded that Israel is commiting genocide against the people of Palestine and is reframing their colonial genocidal intent as "self-defense".
Despite repeated resolutions adopted by the UN's different bodies and the several attempts to address the issue at the United Nations Security Council (UNSC), US vetoes have systematically obstructed progress.
After exhausting all other avenues for resolution, we now believe that invoking Resolution 377 is the only viable path forward for international intervention to bring relief to the people of Palestine.
Resolution 377, known as the "Uniting for Peace" resolution, empowers the United Nations General Assembly (UNGA) to call for immediate action when the Security Council fails to maintain international peace and security due to lack of unanimity among its permanent members. The current dire situation in Palestine, marked by ongoing aggression from the State of Israel, presents a clear case for the UNGA to convene a special session and leverage Resolution 377.
We hold the two conditions for the leverage of Res. 377 are met:
- First of all, due to US veto, the United Nations have been prevented from exercising their "primary responsibility for the maintenance of international peace and security” because of the “lack of unanimity of the permanent members”
- Secondly, there clearly is “a threat to the peace, breach of the peace, or act of aggression”, not only in Palestine, but also against the neighbouring countries of Lebanon, Syria, Iran and Yemen, which have included attacks jointly led by Israel and the United States of America.
The State of Israel's actions against Palestine are well-documented and they constitute a systematic campaign that fits the criteria of genocide, war crimes and crimes against humanity, as well as ecocide.
- In Gaza, Palestinians face extreme hardships such as manufactured starvation, as Israel withholds food, water, and access to medical assistance, which as an occupying force, Israel is obliged to provide. Continuous attacks and repeated bombings jeopardize the Gazans right to life and dignity.
- In the West Bank, similar atrocities occur, including state-approved killings, land theft, destruction of homes, and forcible displacement, all of which are serious violations of international law.
A UNGA session utilizing Resolution 377 could pave the way for substantive measures to halt these grave violations and prevent further harm to the Palestinian people. The situation demands immediate international attention and action, as the mechanism of Resolution 377 does not require the approval of the Security Council, bypassing any potential vetoes. This mechanism would enable members of the Hague group and other willing countries to lawfully send a multinational protection force to Palestine under the UN flag.
It is crucial for the global community to stand in solidarity with the Palestinian people, recognizing their right to safety, sovereignty, and survival. Urging the UNGA to act now could catalyze meaningful change, challenging impunity and seeking justice for those suffering under the current oppressive conditions.
