We Won in California — Now We Need Your Voices Federally

We have incredible news to share:
🎉 We Defeated AB 1088
Victory for California Consumers, Kratom, and 7-OH
AB 1088 (Bains) is officially OFF THE TABLE.
Under mounting pressure from consumers, advocates, researchers, businesses, and stakeholders across California, Assemblymember Jasmeet Bains withdrew AB 1088 less than 24 hours before it was to be heard in the Senate Health Committee.
That means the legislation that would have effectively banned most kratom products and all 7-OH products in California will not move forward in 2026.
Our team and advocates were already in Sacramento, ready to share our stories and fight to protect 7-OH and kratom before the bill was pulled. So instead, we went to the hearing in our yellow “Save Kratom and 7-OH” shirts, to show the committee that we were there in force to fight this ban, and then went door to door to CA regulators, educating them on how important regulating kratom and 7-OH (not banning is)!
It was an incredible day and major victory — and it belongs to YOU.
Hundreds of letters were sent. Countless phone calls were made. People shared deeply personal stories. Advocates traveled to Sacramento and stood together in person.
Every action mattered.
Because of this collective effort, lawmakers heard loud and clear: consumers support responsible regulation, consumer protections, and science-based policymaking — not prohibition.

📢 The Next Big Action: Tell HHS Your Story

Following our incredible response to the FDA public comment period — which resulted in more than 900 public comments — we are moving to the next phase of our federal advocacy plan.
The U.S. Department of Health and Human Services (HHS) is currently seeking public input as part of its Great American Recovery initiative.
This is a critical opportunity.
If kratom or 7-OH has helped you manage chronic pain, improve mental health, maintain recovery, care for your family, return to work, or avoid more dangerous substances, we need your voice.

🏛️ Legislative Updates Across the Country
We also have important updates from other states.
✅ Arizona: We helped defeat a ban bill thanks to a strong coalition of legislators, advocates, organizations, and consumers.
✅ Delaware: We successfully pushed for 21+ age restrictions and a study commission amendment, much of which was accepted and passed.
✅ New Hampshire: A proposed ban bill died after significant advocacy and a last-minute lobbying effort.
With all this amazing news, we still have fighting to do.
⚠️ New York recently passed S. 8925A, a flat prohibition on 7-OH products — without holding a single public hearing and despite more than 5,000 calls from constituent consumers.
We are actively working on a strategy to reach Governor Hochul before this bill is signed into law.

📰 The Truth Is Coming Out
Recently, The New York Times published a major story exposing the complex web of lobbying, financial influence, and backroom dealing behind the war on 7-OH.
The story reinforces what many consumers already suspected:
The campaign against 7-OH has never been about public health or scientific evidence.
Instead, it seems to be driven by money and special interests seeking to eliminate competition while protecting their own products and seeking market domination.
Wired also recently published a relatively balanced piece examining the controversy from another angle, which included commentary from our own Dr. Ross and Jackie Subeck. While not perfect, the article acknowledged several important realities: troubling collusion between some kratom insiders and government officials, the existence of many responsible consumers who rely on 7-OH for wellness and harm reduction, and the fact that the responsible path forward is regulation - not prohibition!
That is exactly why advocacy matters.
When consumers speak up, the narrative changes.

Defeating AB 1088 did not happen by accident. It took months of coalition building, legislative outreach, consumer mobilization, scientific education, legal analysis, communications, travel, events, and around-the-clock advocacy.
That same level of effort is now needed across the country.
As we head into the summer, our team is already preparing for another intense legislative season this fall, with major threats emerging in Massachusetts, Michigan, New Jersey, North Carolina, Ohio, and Pennsylvania, while we continue fighting urgent battles like New York.
