Subject: Urgent Reforms Needed in the Wakf Act
Dear Honorable Chairperson,
We, the undersigned, urge you to consider the following suggestions for the Wakf Act:
1. WAQF assets are a legacy from princely states, not exclusively Muslim.
2. Partition-related claims must be identified and converted to Public or Gov lands.
3. Nominate WAQF as a quasi-public institution, not a Muslim/minority organization.
4. Establish an advisory board with 40% non-Muslim participation.
5. Ensure Muslim representation from all sects.
6. The advisory board reports to the GoI ministry.
7. Cap administrative spends at 25% of revenues.
8. Reserve rights for SC/ST communities.
9. Waqf tribunals must be subservient to High/Supreme Courts.
10. Equalize subsidies, taxes, debts, and rebates with other religions.
11. Allow WAQF assets for govt and secular purposes.
12. Allocate a significant portion of WAQF revenues for community development.
13. Digitize assets for public inspection.
14. Settle pending legal cases within a fixed time.
15. Implement administrative reforms.
16. Disputes/claims over 50 years old cannot be considered WAQF.
17. Verify new claims through government and advisory committee discussion.
18. Conduct yearly audits by CAG.
19. Mandate contributions to nation-building and emergencies.
20. Public notification for objections to WAQF properties.
21. No foreign funding allowed.
22. WAQF cannot claim public, cultural, private, or government properties.
23. Implement bank norms of KYC and AML.
24. Allow WAQF lands for defense and law enforcement agencies.
25. Use WAQF lands for housing the poor of all religions.
