my small concreting construction business faced a devastating financial blow  from a builder we had contracted with, has now went into voluntary administration. This collapse left me with a significant unpaid amount of $56,186. But laws protect him and he can keep his house , boat and cars but we are left to sell our personal items to cover this loss !!!
Unfortunately, this is not an isolated incident, as many small construction businesses and tradies across Australia experience financial distress and instability due to similar builder failures. The impact is personal, profound, and preventable.

The current lack of adequate legal safeguards lets some directors operate precariously, lacking the necessary financial backing. These businesses go under, leaving a trail of unpaid bills and heartbroken livelihoods in their wake.

I urge the Australian Government to consider the following commonsense reforms to prevent future losses and establish a more resilient and fair construction industry:

1. **Implement a minimum capital requirement for companies in the construction industry**. This will ensure that builders have the financial strength to meet their obligations, reducing the risk of insolvency.

2. **Require basic business education or licensing for directors** before they can register a company. This will equip directors with the necessary knowledge to manage companies responsibly.

3. **Hold directors personally liable for trading while insolvent and failing to pay subcontractors**. By holding directors accountable, we protect workers and subcontractors from bearing the brunt of unsustainable financial decisions.

4. **Strengthen protection for unsecured trade**. Ensuring robust mechanisms are in place to protect payments to contractors and suppliers will fortify the construction industry's supply chain.

These measures will not eliminate all financial risk, but they will significantly reduce the frequency and impact of such collapses. We want to see a construction industry where small businesses thrive with confidence and security, not teeter on the edge of financial ruin.
