The Issue

The tragic death of 17 month-old  Baby Elena Hembree has deeply shaken the community in Middlesboro, Kentucky. Her untimely passing has left a void that cannot be filled, and our demand for justice has never been more resonant. The recent plea deal, which offers Harvey Gollahan a mere 15-year sentence for his involvement in Elena’s death, falls short of delivering the justice Elena and her family deserve.

We are calling on Judge Keith Nagle to reconsider this plea deal that will be before his court November 3, 2025 and impose a stronger sentence that truly reflects the gravity of the crime committed. A 15-year sentence does not adequately convey the seriousness of the act nor does it serve as a deterrent for future transgressions of this nature. We believe that a more substantial sentence will not only honor Elena's memory but also ensure that justice is rightly served.

As concerned citizens, we stand united in seeking a fair trial and a sentence that aligns with the severity of the crime. Every voice matters in this pursuit for justice; therefore, we urge you to join us in demanding that Judge Nagle reject the current plea deal.

Our request is not born out of malice, but out of a desire to see justice served for Elena and to reassure the community that such acts will face the full weight of judicial scrutiny. It is crucial for the integrity of our justice system that such acts be judged with the seriousness they deserve. By signing this petition, you are standing up for justice, for Elena, and for the safety and moral fabric of Middlesboro.

Please sign this petition today to urge Judge Keith Nagle to act in the best interest of justice and the community he serves. Let us give voice to the demand for accountability and true justice in this heartbreaking case.
