Upgrade Enticement of a Child to an Offense Requiring Sex Offender Registration
The Issue
This petition is born out of the tragic story of 11-year-old Audrii Cunningham from Livingston, TX. In February 2024, Audrii went missing and an Amber Alert was issued. Her body has since been found and the main suspect is Don McDougal, who had previously "received a two-year sentence for Enticing a Child out of Brazoria County in 2007". McDougal's criminal history also includes assault on Public Servant.
The current law in Texas treats 'Enticement of a Child' as a misdemeanor. This means that individuals like McDougal do not have to register as sex offenders after serving their sentence. We believe this needs to change. A change would benefit parents and guardians to make informed decisions.
According to the U.S Department of Justice, registered sex offenders are four times more likely than non-sex offenders to be arrested for another sexual crime after their release from prison (Bureau of Justice Statistics). By requiring those convicted for 'Enticement of a Child' to register as sex offenders, we can better protect our children from potential harm.
In memory of Audrii and all others who have fallen victim to such heinous crimes, we urge lawmakers in Texas to upgrade 'Enticement Of A Child' from misdemeanor status into an offense that requires registration as a sex offender.
