The Issue
Charlie’s been evicted‼️
Judge Seth Peacock stayed the warrant of eviction, however it expired on August 25, 2025. That same morning, the Tompkins County sheriffs department executed the warrant of eviction, officially displacing Charlie.
This happened due to the adjournment of the motion for injunctive relief on August 20, due to court congestion. The court adjourned this motion until September 15 at 10 AM in person in the Tompkins County Supreme Court.

This motion will allow for other tenants to stand up and speak out against the injustices they face without further retaliation or discrimination.
On August 20 @ 11:30 a.m. the motion for Injunctive Relief was NOT argued in Supreme Court due to a conflict in the morning schedule. While the case was scheduled prior to the lunch hour, the case before ours ran over and the court adjourned the motion until September 15 at 10 a.m. This time, however it will be in person at the Tompkins County Supreme Court, still with Judge Elizabeth Aherne. While we look forward to being seen and heard in court this does not solve the upcoming eviction. The eviction was stayed by Judge Seth Peacock until August 25 @ 5:30 p.m. This leaves one day left before the warrant can be active again. We fear that, even though Charlie did in fact pay their rent portion- in accordance with a settlement order we still haven’t seen, that INHS will still attempt to put Charlie out on the street. We ask that you make a stance with us by signing, sharing and calling Kate De La Garza, Executive Director of INHS, at (607)277-4500. Demand that they #keepcharliehoused until safe housing can be secured. On Wednesday, July 23, Charlie was notified by the City of Ithaca Court that they would have court the following day, Thursday, July 24, at 9 a.m. Charlie recognized that this was extremely short notice for the Motion to Show Cause and requested an adjournment. The court denied this request. These communications took place as previously stated. We decided Charlie would attend via Zoom, due to their disabilities, and I would attend in person as an advocate. So, from my perspective, I will tell this. When Judge Seth Peacock arrived, the court began. I am not sure of the time, but it certainly was not 9 a.m. He began with Charlie's case, which was great! The problems were, Charlie couldn't hear or be heard and had to disconnect and then reconnect. Once that was accomplished, the audio was horrid. It's like every sound bouncing off of every mic in every room, so much so that the judge attempted to speak slower, to give his voice time to bounce through! Charlie, a new advocate for themselves, was attempting to tell their story, which is great, but not where you begin in court. Get straight to your point, so you can be heard! They would not allow me to speak for Charlie as I am not an attorney, nor am I the defendant. I tried, believe me. Charlie did the best they could, at the time, with all things at play that they could. INHS' counsel, along with Logan Lincoln, sat in the court, passing a note back and forth to each other while Charlie spoke. Christopher Smith was released as counsel, and I swear, I have never seen an attorney get out of a courtroom faster! After all this, and Charlie's best attempt to answer the judges' questions, even though there were obvious technical issues, the judge said he would review the tapes. This was also after I stood up in the courtroom because I could not sit silent any longer! I explained that Charlie was not using the correct language to express the issues. I was again denied the right to advocate for them. Judge Peacock took a break to review the mediation transcript. Do you all know how exciting it is to learn that there is documentation of what happened in that room??!! I cannot wait to see it and add it to my very own case as an exhibit. While he went and did that, I drove over to Charlie's and discussed what was happening. We consoled them, and hoped for the best, and waited. The order of the court is to stay the eviction until August 25, 2025. That gives us one month for one of two things to happen. The first thing that could happen is Ithaca Neighborhood Housing Services Inc. could decide they see the error of their ways, and #stopthiseviction as it is certainly retaliatory. They could start to make it right for Charlie, rather than doubling down. The other thing that will happen, regardless of what INHS decides to do, is on August 20, 2025, at 11:30 a.m. I will orally argue my motion for Injunctive relief to give ALL tenants the right to freely speak. After granting this motion, tenants of INHS will be able to speak up and out without fear of situations like mine and Charlie's. Yesterday, we won a small battle. One of many.
