February 23, 2017 Commission on Retirement, Removal and Discipline Mr. James Smith Esq. Administrator and Counsel: 2190 S. Mason Road, Suite 201 St. Louis, Mo 63131 Dear Mr. James Smith Esq: Thank you for responding to our letter regarding Judge Chris Kunza Mennemeyer. This letter is to file additional formal complaints against Judge James Beck, Judge Chris Kunza Mennemeyer for conspiring with the Prosecutor Leah Askey Chaney to deprive defendants of due process in cases involving the Court Alternative Program and or Novellus LLC. Novellus LLC is owned by Leah Askey. I would like to incorporate by reference the complaint filed against Leah Askey (aka Leah Wommack Chaney) with OCDC dated December 14, 2016. (Attachment 1) Leah Askey’s record demonstrates innocence or guilt does not matter when she charges someone with a crime. Then she would offer them a deal to go to the court alternative program(“CAP”). The defendants would stay in apartments owned by Leah Askey’s corporation Novellus LLC. The Court Alternative Program (“CAP”) would then pay Novellus LLC rent for a few months using court money. (Attachment 2) The defendant would be required to sign a lease with Novellus. Leah has also leased a unit to Counseling for Resolution, which they were also ordered to use. The apartments are by Leah’s own admissions uninhabitable: filled with mold and frequently back up with sewage. (Attachment 3) The aforementioned Judges knew that Leah Askey owned Novellus LLC and participated by signing various types of orders including orders into the CAP to rent Leah Askey’s slum apartments, eviction orders and judgements. The “good’ Judges without disclosing to said defendants that Leah Askey owned the apartments and they were slum properties at best. The Court Alternative Program “CAP” was offered frequently to defendants who were being held in the Lincoln County jail who could not afford bond. It is a habit to delay trial repeatedly to incur maximum damage on a defendants life especially to those who refuse said plea deals. We have reports of people being held in jail for up to two years without a trial. Even though they begged for a trial. Leah would claim that she was too busy or needed to go to the Lake and the case would be continued. Leah Askey had a liquidity problem that was well known to the Judges with the Novellus property and they conspired with Ms. Askey to use court monies to bail her out of her dilemma. The signing of a lease as a condition of probation is a contract without free will. The whole thing is a conflict of interest on its face and a conspiracy to deprive defendants of due process and equal protection. When the defendants wanted repairs or out of the lease, Leah would file for eviction and the “good” judges would sign the evictions and the money judgments in furtherance of their scheme. Leah Askey also is the signatory on an account for The Rise Above Scholarship with her aunt. The Rise above Scholarship is a “charity” that operates out of the Lincoln County Prosecutors office.The Rise Above Scholarship was also used by Leah Askey and the “good” Judges to aid Leah Askey’s liquidity problems for her Novellus LLC properties. (See attachments 4) Note the signatures although purported to be from different people look remarkably the same. Our board is very concerned that your board disclose any investments in any prison for profit or support services for Missouri jails. We would ask that anyone on the board who holds such investment disclose to us that they hold said investments and recuse themselves from further consideration of this complaint. Thank you in advance for your thorough consideration and ACTION on our complaints. We are regular people trying to navigate a very corrupt situation to restore order to the county. It appears to us that the Commission does not understand the gravity of the situation and the abuses that are continuing against a poor, uneducated populace on a daily basis. We understand that brilliant legal minds do not understand the damage that unfounded criminal charges can do to a person’s life from both a financial and emotional standpoint. Perhaps a face to face meeting with our group and the Commission might help you to empathize to the point it will motivate you to action.
