(Norway) Ambassador Siri Sletner met with President Miloš Zeman to discuss the Michalák case on Thursday 5 February, 2015.
Ambassador Sletner stressed that the Norwegian government understands Czech concerns in the case relating to the Michalák brothers, and expressed appreciation for the good dialogue that exists between Czech and Norwegian authorities on this matter. There are now plans for a meeting between the Czech Office for the International Legal Protection of Children and the Norwegian Directorate for Children, Youth and Family Affairs in the near future.
Ambassador Sletner explained that Norwegian child welfare legislation puts the child’s best interests at the centre of all decisions. Norwegian legislation applies to all children resident in Norway, regardless of their background. All care orders are passed by an independent and impartial Board - the County Board for Social Affairs - not by the child welfare authorities. Children and parents have important legal safeguards in such cases, and they can demand a review of their case once a year. The review can, in turn, be appealed through the court system. Throughout this process, parents have the right to legal assistance through a lawyer of their choice and for the cost of that legal assistance to be paid for by the state. The Michalák case has already been tried on several levels in the court system, and each has upheld the decision to keep the boys in foster care.
Only the family involved has full access to all documentation relating to the case. It is the family’s privilege to decide whether to share that information with anyone else, including with Czech authorities.
