The Issue
A fair System?
Mothers can lie on the Child Maintenance application form, such as contact with the child.
She does not have to submit any evidence to back their claim.
But the Father has to provide evidence to show he sees their child regular and the cost of travel through a variation form. Such as texts and bank statements to prove travel costs and they see their child regular.
By what I have discovered and read the Variation form is a waste of time.
The initial calculation for your monthly payments, comes from your annual salary before deductions.
If you have done overtime the month the application was put in, they will take that as your yearly wage and you cannot change that. This is also inflate their calculations for your monthly payments.
Unless you have a 8% drop in your annual salary they will look at changing your wages.
How is that fair?
CMA has said they treat all cases the same they don’t have time to look at each case individually. They use a blanket policy for all cases, which was told to me by one of there agents.
They use the HMRC car company to calculate miles even though you have evidence it costs you more.
For example if you have a 1.4 litre petrol and the journey is 320 miles round trip, according to the HMRC calculator that is 12p a mile, so that would cost just under £40 in fuel?
£40 for a full tank of fuel is a miracle with the current cost of fuel
This is a bias and corrupt system for genuine dads, who want to see their children. It leaves many men crippled with debt and unable to afford to see their children. Fathers have taken their own life’s because of this system
The system needs to be changed so it is looked at by a case by case not just one mould fits all. The mother also should provide evidence to back their claim.
I understand there are dads who don’t bother with their children and do not pay. But for hard working dads who want to see their children this system is a nightmare.
