stop Advance Decisions being overruled by Mental Health Act
The Issue
Under every other health profession, whether it be cardiology, neurology or podiatry, advance decisions by people with the mental capacity to make them cannot be overruled, so why, in psychiatry under the 'mental health act', should advanced decisions, a legally binding document be able to be overruled by mental health professionals? This leads to people who are dead set against potentially physically damaging invasive treatments (such as electroconvulsive therapy, psychosurgery, deep brain stimulation, psychiatric medication and others) being forced to have these treatments against their will while detained under the mental health act, even if they have written and signed an advance decision while mentally capable to do so that directs that they DO NOT want these 'treatments'. Psychiatry, unlike all other health professions, where a patient can refuse even life-saving treatment with a advanced decision, 'approved mental health professionals' can override advance decisions.
This is clearly wrong and unfair, why should people suffering with mental disorders be completely unable to refuse certain brain damaging treatments by using a legal document which has to be obeyed in every other medical profession, the advance decision, to state that they do not want these physically invasive and damaging treatments?
