Petition for Transparency, Accountability, and Restructuring of the "Bucyrus Music Boosters"

To: The Leadership of the "Bucyrus Music Boosters", the General Membership, and the Administration and Board of Education of Bucyrus City Schools.

Purpose: We, the undersigned members, parents, alumni, and community supporters of the Bucyrus City Schools music program, hereby formally declare a vote of No Confidence in the current leadership and operating practices of the organization currently doing business as "Bucyrus Music Boosters".

We demand an immediate freeze on all non-essential expenditures, an independent audit of all financial records, the immediate release of all governing documents, and the reinstatement of lawful, democratic election procedures.

Statement of Grievances

We are bringing this petition forward due to severe violations of standard non-profit governance, deliberate concealment of organizational rules, and deceptive administrative practices:

Concealment of Governing Documents: The leadership has actively refused to publish, share, or make available the organization’s bylaws to its general membership. This deliberate withholding of the corporation's rules violates basic rights of members to inspect corporate records under Ohio law (ORC § 1702.15) and prevents members from verifying the legality of board actions.

 Unregistered and Deceptive Operational Identity: The organization is actively operating, soliciting funds, and conducting business under a name that is not legally registered with the State of Ohio or recognized by the IRS, creating severe liability risks and violating Ohio corporate registration laws.

 Establishment of an Unauthorized "Shadow" Governance Body: The leadership has enabled an exclusive, unrecognized "active members group" to make organizational decisions and vote on amendments outside of general, open meetings to circumvent the voting rights of the general membership.

 Deliberate Suppression of Notice and Communication: The leadership has actively blocked and restricted general members from viewing the organization's primary digital communication channels (Facebook), intentionally preventing members from receiving proper notice of meetings, agendas, and voting cycles.

 Entrenchment of Leadership: The current officers have weaponized their lack of transparency to entrench themselves in power, operating under the false pretense that officers of this organization cannot be questioned, challenged, or held accountable by the community they serve.

 IRS Tax Compliance & Inurement Exposure: The leadership maintains the illicit practice of managing "individual fundraising accounts" (IFAs), tying raised funds directly to specific students rather than the collective benefit of the program. This practice directly violates IRS 501(c)(3) tax laws regarding private inurement and private benefit, placing the entire tax-exempt status of the organization—and its individual members—at severe financial and legal risk.

Action Items Demanded

By signing below, we demand the following actions be taken immediately:

1. Immediate Production of Bylaws: The immediate physical or digital publication of the current bylaws, along with all historical amendments, to the entire general membership within forty-eight (48) hours of the delivery of this petition.

2. Dissolution of Unauthorized Committees: Immediate cessation of all decision-making and voting conducted by the unauthorized "active members group."

3. Restoration of Communications: Immediate unblocking of all general members from official communication channels to ensure equal access to information and proper legal notices.

4. Indemnification & Tax Compliance Verification: The board must immediately produce a formal written statement or letter from a licensed, independent Certified Public Accountant (CPA) or accounting firm that explicitly indemnifies and holds harmless the organization, its general membership, and the school district and its staff from any federal, state, or financial liability resulting from the group’s use of individual student fundraising accounts. If no accredited accounting firm will certify or indemnify this practice, the group must immediately liquidate these individual accounts into the general fund and cease the practice entirely to preserve tax-exempt status.

5. Special Meeting and Open Elections: The scheduling of an open Special Meeting of the General Membership to hold fair, transparent elections for all officer positions, overseen by an independent nominating committee.

6. District Intervention and Sanctions: We formally request that the Bucryus City Schools Administration and Board of Education immediately suspend the group’s authorization to operate on school grounds, use school facilities, or utilize the school's name/branding until the organization proves full legal compliance with the Ohio Secretary of State and the IRS.
