On 12th July I sent CrowdJustice supporters an email summarising the judgment. The High Court upheld the ground that the policy was in conflict with the Local Plan, and indicated that the Neighbourhood Plan policy was ill-founded - because it wrongly believed that Wicklesham Quarry benefited from a presumption in favour of development. In spite of the policy failing to meet the basic conditions, we were not awarded the judgment, and the Court awarded £5,000 costs (capped under the Aarhus Convention) against me. From our original fund of almost £15,000, over £8,000 has now been used to meet adverse costs, court fees and stationery (court bundles). About 25% of my barrister's and solicitor's fees have been paid.
The second CrowdJustice Appeal raised £4,560 towards our target of £20,000. My legal team understood our situation but wanted to support our case, which we believed should win. We all took a deep breath, and carried on. Now I intend to launch a further CrowdJustice Appeal in order to try to repay their incredible hard work and commitment on behalf of Wicklesham Quarry. Having achieved so much through our case, it would be unfair that they should bear the cost.
Next week I shall send you a link to the new Appeal, and I hope you will make a final contribution. Having had to time to digest the verdict, local people who have supported this cause over the past three years feel that we have already achieved most of our goal. The policy is disabled for five years until the present planning conditions, which are a 'county matter', have been complied with. This means the landowner must carry out a 5 year Aftercare Plan to restore the quarry to agricultural use. Local supporters believe that there is now little prospect of the quarry ever being developed as an industrial site.
Until now, District and County Councillors knew little about the planning history and local politics surrounding Wicklesham Quarry and Faringdon Neighbourhood Plan. But following the Judicial Review they are now scrutinizing what has happened in Faringdon. We believe that, as more of the story emerges, they will not wish to be associated with this abuse of localism.
