"The genesis of the current dispute was a hurriedly crafted law in Somalia 42 years ago, and which appears to have caught Kenyan officials sleeping on the job.
On September 10, 1972, then Somalia dictator President, Siad Barre, decreed the law on Somali Territorial Sea and Port which is commonly known in the war ravaged country as Law No 37. With this law,the dictator laid a unilateral claim on sea and marine land stretching from the Gulf of Aden and deep into Kenya’s territorial waters.
But as it stands now, the land officially belongs to Somalia until the the dispute is finally determined at an on-going case at the International Court of Justice at the Hague. So sensitive is the matter that when contacted by the People Daily, Attorney General Githu Muigai could only say: “Some things are best kept out of media.”
