WE THE PEOPLE DEMAND AN IMMEDIATE RETURN OF ASHLEY NICOLE MILLER'S DOGS "KODA", "PHANTOM", "APOLLO", "SCOOBY" AND "COWBOY" TO HER AS THEY WERE WRONGFULLY AND UNLAWFULLY STOLEN FROM HER BY CITY AUTHORITIES AND 4 TEXAS RESCUES.
This petition is important because the human rights of the owner of these dogs (who was NEVER CONVICTED of any crime) were completely violated.
The 5th and the 14th amendments protect us from having our property taken away unlawfully through the rights to "due process" of the law. That did not happen in Ashley Nicole Miller's case. Her dogs were illegally confiscated from her with no warrant and sent to rescues without ever going to a hearing or a trial. This is a violation of both State and Federal Laws.
The following rescue groups, Texas Husky Rescue, Heart of Texas Lab Rescue, Tails of Hope Pet Rescue, and Forever Homes Rescue in Texas illegally obtained her dogs and were given demand letters from an attorney ordering their return. They instead participated in the illegal trafficking of stolen property by adopting Ashley's dogs into homes. They have also resorted to attacking Ashley online, threatening her with smear campaigns, and they have publically humiliated her.
The 6th amendment authorizes the accused in a crime to examine any and all evidence against them in a court of law. Ashley's dogs were dispersed, therefore destroying the evidence and any possibility for expert veterinarians of the defense to examine said evidence.
Apparently, the Animal Control within the city of Killeen, Texas also has a history of doing this to other people. Ashley's dogs were held over her head for a very large price tag of over $2,400. She was allowed to get them back, provided she pay that fee which also increased at a daily rate. It is illegal through both State and Federal Laws to impose a fine on a person's property without them ever being found guilty of a crime. It is also illegal to disperse of their property without being found guilty of a crime.
This is a huge injustice and a violation of both Human Rights, Civil Rights and Property Rights as defined under both the State and Federal Constitutions that govern Texas Law. Please help Ashley's dogs to come home by sharing this petition or following this on facebook. Although Ashley was ACCUSED (please educate yourself on the definition of this word before you go running around saying she is guilty as an accusation is not a fact) of animal cruelty, she has never had a chance to present her side to a court, and was stripped of her property (the dogs) without being allowed to do so. I was wrongfully accused of animal cruelty on May 25, 2011. I was not only accused, and arrested, but my dogs were taken from me without a warrant, a hearing, or any sort of "due process" of the law.
Texas Laws and Federal Laws are set in place to protect a person from being deprived of "life, liberty, or property" yet my dogs were taken illegally and dispersed to different animal rescue organizations throughout the state of Texas.
Despite the fact that I have begged the rescues to return my dogs, as well as having my attorney send them demand letters ordering their return, they have been entirely uncooperative and claim to have "adopted" my dogs out to other individuals.
The animal rescue organizations which received my dogs have smeared my name and publicly threatened myself, as well as harassing me and destroying my character through various sites such as "facebook" and "pet-abuse".
These organizations have also gotten their friends to assist them and have been at all of my court appearances. They have stalked me both online and offline.
I have never been to trial. I have never been convicted. The most important thing to me in life are the lives of my animals. Without my dogs, I am incredibly broken-hearted.
I am incredibly disgusted that I have served my country overseas in Iraq as a soldier in the United States Army and I come back to a "free country" where my rights are supposed to be upheld to protect myself and the freedoms of the American people. Sadly, that is apparently not the case as city organizations are allowed to break the law without any accountability being held for their actions.
No one should have to feel this or go through this type of pain. Please bring my dogs home and strip the 501(c)3 status from the rescues who have partaken in the illegal trafficking of my dogs to other individuals.
Collusion is supposed to be illegal when it comes to an open investigation or trial. Supposed witnesses and members of the prosecution along with Texas Husky Rescue, Heart of Texas Lab Rescue, Tails of Hope Pet Rescue in Texas and Forever Homes Rescue of Texas as well as members of the Killeen Animal Shelter have participated in colluding stories and corroborating attacks against me online. This has affected me in so many ways.
Please uphold justice and assist me in getting my dogs home.
