The Issue

If the Bar (a license test required to practice law) is graded equally across America, then why aren't all accredited ABA (American Bar Association) law schools using the same grading system too?

I was recruited by a law school, that I'd never heard of and offered a huge scholarship. Like most of my class, we lost this scholarship by the second semester. That's when this new grading scale started to become part of the conversation... 

A grading scale, claimed to still be a bell curve. This low curve was created out of thin air without a single source of educational research.

Most ABA law schools use a 3.5 curve and all students graduate. Some schools like Georgetown use a pass/fail grading system. Then, these predatory schools - that you've never heard of - use this predatory business model and low curve to give half the class Ds and Fs. 

This predatory business model is exclusive ABA law schools, and unheard of globally. It gives lower grades to students working just as hard as their peers at other ABA schools (whom use easier grading scales). 

This predatory curve is a procedure that uses a low  rank-based median bell curve  to arbitrarily give students lower grades - half of them below a 2.5 GPA - making academic dismissal iimmenient. FASFA loans demand a mandatory 2.0 GPA to continue getting loans.

In 2019, the Society of American Law Teachers (SALT) wrote to the ABA about the disparity between test scores on standardized tests like the Bar. These pressure tests - like the K-12 state tests - are not accurately representations of an individuals actual knowledge. Further, the Harvard School of Education has data backed research to prove this disparity. Especially students facing economic disadvantaged and learning disabilities like ADHD. However,  the ABA passed Rule 316 and demand that all accredited law schools must have a 75% bar pass rate. This rule encourages low ranked law schools to use the predatory low bell curves because they can academically dismiss the bottom half of every class. They assume that will increase the schools bar pass rate.

Most of the schools using this predatory policy state the low curve grade scale ensures that students will not go into debt for a career they will fail at... What? This policy does just that, now I have 2 yrs of a JD and over 200k of debt.. Its bad faith and a predatory policy that inevitably will put half their student boy into debt with a partial JD degree.

If we study the same material at all ABA law schools and we take the same bar at the SAME TIME - then why do we get different grading scales? Why is the bottom of the class at Harvard is allowed to graduate and take the bar. Yet, the bottom of the class at low curve schools are academically dismissed and "deemed unqualified" to take the bar...

According to a report by the American Bar Association, a prominent number of law schools in the country utilize similar predatory practices, offering scholarships, only to often revoke them after the first year. This method causes undue financial strain on students, affecting their studies and their futures (source: ABA Report).

This practice is not only unethical but detrimental to the integrity of the legal field. We, the law students of America, are calling upon the ABA to end the accreditation of any law school which utilizes this predatory business model. Endorse this petition to stop this exploitative practice, stand up for law students around the country, and push for a more honest and transparent law education system.
