The Creative Arts Act could [partially] solve AI data scraping.
The Issue
As of the making of this petition, The C.R.E.A.T.O.R. Act was introduced 4 months ago. The CREATOR Act seeks to prevent people and companies from using AI [to impersonate art styles] for commercial gain. The act only protects visual art like paintings and ceramics, ignoring other forms of art like music, filmmaking, and writing. The following law presented, The Creative Arts Act, will address the problems The CREATOR Act doesn't acknowledge.
Here is a summary of The Creative Arts Act :
The Creative Arts Act will be a law that prohibits AI models from being fed scraped art from human artists. The way it will work is that any piece of art(sketches, digital drawings, pen and paper, photography, classic art, modern art, sculpting, filmmaking, voice acting, animating, singing, writing, etc) will be put under The CA Label. The label will protect current and future pieces from digital manipulation by AI tools. When the artist dies, the label will stay for the number of years the person lived. However, that system will only be implemented for artists over 18 years old. Child and teen artists will have the label stay 18 years after death.
This act cannot protect already scraped pieces, but it can protect future projects and art. If an ai company scrapes art [after the creation of this act], the artist is entitled to compensation from the company. And any one who sells AI images [based off of these works] will be forced to give 10% to 20% of their profits (depending on the amount of money made each day from the image) to the artist.
To preserve the safety of art [under this label], artists willing to donate pieces are required to remake the piece of art they are submitting. Depending on the type of art, the person will either be required to draw the image [digitally or on pen and paper], have permission from the people in the photo, create a mini version of the sculpture they are submitting, recreate the clip they are submitting (with the cast's permission), create an almost exact replica of the audio clip they are submitting, or sing a line from the song they are submitting. All of them will have to be done through a live call with an employee.
The review will last 7 to 9 business days before the art can be submitted. This will be a one time occurrence, however, if major changes happen like a new art style or a new type of art, the process will be repeated again.
The employees themselves will be split into multiple seprate groups, with each group representing the different types/styles of art. So if a piece is reminiscent of a specific style of art, the group who specializes [in that specific style] will look through the image and note similarities between the art and the piece created. If glaring similarities are found in the recreated art [but the person insists that it is fully original], the image will be saved for and additional 2 week review, and the artist cannot submit additional images during this time.
To prevent abuse or misconduct on the employees side, 5 representatives will oversee each group and look out for potential misconduct or favoritism.
Outside of AI, if the artist's specific art style is recognized as unique, with no prior records or timestamps [of that art style from the past], The CA Label will be upgraded to level 2, where the person will be recognized as the creator of that art style and future works will be considered inspired or fan works. And any mention of that art style in an educational context will also include the person who created it. If a company uses that same art style in a commercial, the creator will receive a share of the money for each view the ad gets.
An additional thing to note is that Journalism will also be classified as a form of art, therefore it will also be protected under the label. However, what makes this different from the rest is that the Journalist cannot submit any documentation to the AI generator. With this, bad actors will no longer be able to modify the narrative of ongoing situations and share it under the guise of real news.
In closing, this act is meant to address a current issue involving the theft of art with digital manipulation. However, this is not the only issue related to AI. And thats where Operation : Killswitch comes in.
