We the citizen of india are concerned with India's new Citizenship (Amendment) Act 2019 is fundamentally discriminatory in nature.


The Aims of the Citizenship (Amendment) Act, 2019 passed by the Govt. of India to grant citizenship for religious minorities – naming specifically only Hindus, Sikhs, Buddhists, Jains, Parsis and Christians - fleeing persecution in Afghanistan, Bangladesh and Pakistan, who have been entered into India till December 31, 2014. But it does not extend the same protection to Muslims, including minority sects.


Even the UN High Commissioner for Human Rights expressed the serious concerned that The amended law would appear to undermine the commitment to equality before the law enshrined in India's constitution and India's obligations under the International Covenant on Civil and Political Rights and the Convention for the Elimination of Racial Discrimination, to which Indian is a State party, which prohibit discrimination based on racial, ethnic or religious grounds.


This Act violates article 14, 15, 21 and 25 of Indian Constitution. The Religion cannot become a basis in giving or depriving a person from the citizenship.


The whole idea behind the Act is to divide the nation on religious and sectarian lines. It creates fear among the people belonging to the Muslim community. It also compels Muslims to leave their faith and adopt some other religion to save their citizenships. This is totally divisive and unconstitutional Act.


We heard repeatedly that this will be implemented along with the NRC. We have seen the result of NRC exercise in the state of Assam, where about 19 lakhs people are kept out of the NRC and among them 14 to 15 lakhs belong to Hindu Communities. The Exercise had been painful and affected people belonging to Dalits, Tribal's, OBCs, Muslims and other poor belonging to all the communities.


If the NRC and CAA implemented together, then the people belonging to Hindu communities even if unable to produce the required documents, will be declared refugees and will be given Indian Citizenships. This means that the real burden will be only on Muslims to prove their citizenships. This will cause statelessness and hardships on Muslims, who have been living in India for thousands of years and majority-majority of them are the original inhabitants of India.


It runs against the religious pluralism and spirit of tolerance of the Indian nation. If it is implemented, it will destroy the brotherhood and common fabric among the people. 


Therefore, It's our humble request the Hon'ble Chief Justice of India & Lordship’s Companion Justices of the Hon’ble Supreme Court of India to strike down the unconstitutional Citizenship (Amendment) Act, 2019 to save the secular fabric of our constitution in India and across the world.
