I will be meeting with Jared Staples, Policy Advisor to Texas Governor Greg Abbott tomorrow, June 22, 2016 to deliver our petition.
If you recall, our petition stems from the Fun 5's scratch ticket which
involved selling misleading lottery scratch-off tickets. These tickets were designed by GTECH (International Game Technology) and were sold by the Texas Lottery Commission. The ticket design was that of a winning ticket but the Texas Lottery refused to honor the face value of the tickets sold.
The purpose of the petition and my meeting tomorrow is two fold.
First and foremost, we are asking Governor Abbott to extend consumer protection to Texas lottery players. When Texans feel they've been wronged in some way by a business, they are able to file a complaint with the Attorney Generals Consumer Protection Division. Once a complaint is filed, they investigate and can force a company to do the right thing.
If a lottery player has a complaint and calls or files a complaint with the Consumer Protection Division, they are told "sorry we can't help you." Call the Texas Lottery to settle your dispute.
It is for this reason that Executive Director Grief was not concerned when the lottery was receiving 100 plus calls per day for seven weeks regarding the Fun 5 scratch tickets. Mr. Grief knew that players had no recourse so he proceeded to take advantage of the Lottery Players.
It appears Executive Director Grief has sovereign immunity meaning the Texas Lottery can not be sued.
So we're asking him what protection does he, the Governor, believe should be given to lottery players if the TLC's executive director decides to sell deceptive tickets to Texas players. I'm hoping to explain to him that both GTECH and the TLC have an incentive to maximize profits since as there is no agency that is able or willing to keep them both honest.
The Texas Lottery players deserves better than this.
Next, we want to ask the Governor why he's allowing the Executive Director and the Chairman of the Texas Lottery to retain their jobs in light of all that has come to light in the past couple of years.
Examples of Director Grief's action include:
i) a recorded deposition where Director Grief repeatedly states "he doesn't care what players want" or "he was not concerned with the players complaints"; ii) failed to balance the prize payment account for 5 years; iii) lost state money through fraudulent checks not being caught; iv) kept $35K in prize money that should have been turned over to the Comptroller of TX; v) sent a press release stating that players won trips to Las Vegas then refused to honor the prize - they too had no recourse; vi) at will firings that the legislature stopped plus a number of other things.
As for Chairman Krause, he omitted pertinent information from his Governors Appointment Application. This is known as lying by omission - he failed to list his lawsuit he filed against the IRS.
When I read and saw that Mr. Krause claimed he spent $2.8 million Canadian dollars on his tax return when he actually paid $20,000 for them; then he claimed on his tax return that he sold them at a loss of <$2.7 million> when in fact his loss was actually <$500>. He sold them for $19,542.
So secondly, we're asking the Governor to restore fairness and honesty to the Texas lottery. It is a $4 billion dollar industry managed by individuals with questionable character who apparently lack having the quality of integrity.
These are the two points I hope to convey tomorrow. I am not going there to discuss the Fun 5's case. Rather, we're asking for consumer protection for lottery players and for trustworthy individuals to run our state lottery.
Let me take another minute to Thank You again for all your support. I will be presenting Mr. Staples with 9000+ signatures and comments asking that our voices finally be heard.
