Tell California Lawmakers to vote NO On CA AB 1949 "CA Children’s Data Privacy Act"

The Issue

California Assembly Bill 1949, "California Children’s Data Privacy Act", looks to build upon the California Consumer Privacy Act of 2020. Introduced and backed by a combination of California Attorney General Rob Bonta (D), Senator Nancy Skinner (D) of Senate District 09, and Assemblymember Buffy Wicks (D) of Assembly District 14.

It is important to protect the privacy of minors engaging with the internet, and the foundational idea of enforcing social media platforms and websites to have mandatory restrictions where users must opt in in order for their data to be collected is not a bad idea in itself. However, the restrictions to internet users under 18 also come with the caveat that users under 16 years of age must have parent or guardian approval for any opt-in. This, of course, cannot be enforced properly whatsoever unless the intent is to also require potentially invasive identity verification of both the minor and the parent/guardian.

If the California government really wants to protect the data and privacy of its consumers, both adults and not, then their energy would be better expended by making comprehensive data protection regulations that prevent all data collection and sale. Rather than strict parental controls with potential further reaching online privacy issues.

Don't allow our California government to push us into more restrictive internet laws in the name of the safety of California's children and teens. Push our lawmakers to create comprehensive data privacy instead.
