I have some great news for you!
In a landmark judgment on March 30th, 2016, the Hon'ble Supreme Court of India has made the entire policy for protection of Good Samaritans BINDING on all States and Union Territories of India. The guidelines will now have the "force of law”. Non-compliance will amount to contempt of court. You can read the full judgment here: http://goo.gl/tzLnHw
This is a BIG win for all of us! No one should fear any harassment for helping an injured person on the road.
I, along with SaveLIFE Foundation, had filed a PIL in 2012 in the Hon’ble Supreme Court of India asking for protection of Good Samaritans, who help road accident victims, from any kind of legal or procedural hassles.
Following an order of the Hon’ble Court, the Government of India issued detailed guidelines for protection of Good Samaritans on May 12th, 2015. You can access the guidelines here: http://goo.gl/D8hG92
On January 21st, 2016, the Government took one step further to support the guidelines and issued Standard Operating Procedures (SOPs) for examination of Good Samaritans by the Police or during trial. However, the guidelines and SOPs were being treated merely as an advisory by most States since they did not have statutory backing, we appealed to the court again to give statutory backing to the guidelines. But now, the Hon'ble Court has made the policy binding.
