NY Attorney General's Office Monitoring This Change for Illegality


According to a letter received by a supporter who reached out to the Attorney General's office of New York State, the Attorney General's office is monitoring this change for illegality and consumer harm.
According to some unaffiliated attorneys familiar with the matter, T-Mobile allegedly advertised their plan's rates by including the $5 a month per line autopay discount to consumers without mentioning the full cost of the plan, in statements such as "only 40 dollars a line per month with autopay." And in other areas, "only 40 dollars a month" then containing a small disclaimer that simply said with 5 dollar a month autopay discount applied. This lead people to believe this was actually their plan rates that because they were signing up with autopay, it was the actual rate of the plan whereas had they signed up and not had autopay at the time of signing, the plan would have been an additional cost.
Because of this, the idea of removing autopay options from customers constitutes a breach of contract. For all intents and purposes the autopay discount was taken into account by customers when making a consumer decision on which product or service to purchase. It is misleading to present a cost of a plan to customers, agree to that cost and then alter the cost of the plan by removing the discount they were promised from the beginning via advertisements.
Autopay was allegedly never described during point of sale transactions as a promotion or anything of the sort to many consumers who have voiced concerns since this information became public. Some were even told that as long as they paid specifically by credit card each month, their plan was the amount quoted. In fact, in a large number of circumstances, the plan cost was most commonly quoted including the autopay discount without mentions of it being tied to any to any form of payments. This lead customers to believe this was actually their plan rates. Not with a caviat or anything of the sort.
Many customers have come forward stating that they were mislead in stores because of this. They were allegedly lied to essentially, and told that their plan rates were such and such and are now facing changes to this rate when they were lead to believe because they signed up with autopay in the form of payment they chose that the rate was what they saw at the point of sale and what they were quoted by company representatives at that time. This is blatant abuse of consumer protection regulations and safety measures. It cannot stand.
