Article 14: Equality Betrayed:The Constitution mandates equality before the law. Yet, a discriminatory practice persists, carving out an exception for a specific group based solely on their religious vocation.
Every Indian citizen, regardless of profession or faith, deserves equal protection. To deny priests and nuns this basic right is to create a caste system within citizenship itself.
Article 21: Liberty Denied:The right to life and personal liberty, the cornerstone of our democracy, is being eroded. Intimate relationships are intrinsic to human existence, a fundamental aspect of personal liberty.
To deny these individuals the right to love, to form families, and to experience the fullness of human connection is to inflict profound psychological and emotional harm.
Article 25: Religious Freedom Misconstrued:While we respect the sanctity of religious freedom, it cannot be wielded as a weapon to violate other fundamental rights.
The state's duty is to ensure that religious practices do not become instruments of oppression, that they do not infringe upon the basic human rights guaranteed to every citizen.
Challenging the Anachronistic Doctrine of Celibacy
The Catholic Church's doctrine of celibacy is an internal matter, a religious policy that holds no sway over the state's obligation to uphold constitutional rights.
The state has no business policing the bedrooms of its citizens based on religious tenets.
It is well documented that the celibacy rule has fostered a culture where sexual abuse is more likely to occur.
The psychological damage caused by forced celibacy is severe.
The world is changing, and many religious leaders are questioning the validity of this rule.
International Standards: A Mirror to Our Shortcomings
India, as a responsible member of the global community, is bound by international human rights treaties that protect the right to privacy and family life.
The denial of conjugal rights to priests and nuns stands in stark contrast to these international standards.
Many other nations have found ways to honor religious freedom, while also honoring human rights.
Our Plea: A Call for Justice
We implore this Hon'ble Court to issue a writ, declaring the denial of conjugal rights to priests and nuns unconstitutional.
We urge the Court to affirm that religious freedom cannot be used as a shield for discrimination.
We seek a ruling that restores the dignity and fundamental rights of these dedicated individuals.
